Terms of Service (TOS)
Upgrader
As amended on 20 October 2026
These Terms of Service set out the legally binding terms on which access to the Platform and the use of its functionality are provided, define the scope of the rights, obligations and liability of the Operator and the User, establish the procedure for carrying out transactions through the Platform, and allocate between the Parties the legal, property, technical and other risks arising in connection with the use of the Platform.
This Agreement shall be applied together with the Privacy Policy, the Cookie Policy, the AML/KYC Policy, the rules of individual promotions, the special terms of use of particular functions of the Platform and other documents published by the Operator on the Website and expressly designated as an integral part of the contractual relationship between the Operator and the User.
Before registering an Account, Topping Up the Internal Balance and (or) carrying out any Game Transactions, the User must independently, carefully and fully read the terms of this Agreement and the related documents, assess the legal, property, economic, technical and other consequences of accepting them, and make sure that they have the necessary legal capacity and lawful grounds to use the Platform.
Registering an Account, Topping Up the Internal Balance, carrying out a Game Transaction or any other actual use of the functionality of the Platform in the cases and in the manner provided for by this Agreement constitutes full, unconditional and unreserved acceptance by the User of the terms of this Agreement to the extent permitted by applicable law.
The User must refrain from registering and must stop using the Platform if they do not understand the legal meaning or content of individual provisions of this Agreement, do not meet the established age and legal capacity requirements, do not have the necessary authority, or if the use of the Platform or of any of its functions is prohibited or restricted by the laws of the state or territory of their actual location, citizenship, residence or any other jurisdiction applicable to them.
1. General provisions
1.1. These Terms of Service (the “Agreement”) are a legally binding contract between the administration of the Katenza website (the “Operator”), on the one hand, and a natural person with full legal capacity who accesses the katenza.pro website and uses its software components, interfaces, information systems and (or) other functionality available through it (the “User”), on the other hand, together referred to as the “Parties” and each individually as a “Party”.
1.2. This Agreement sets out the terms and procedure on which the User is given access to the Platform and governs the relations of the Parties arising in connection with the registration, creation and use of an Account, Topping Up the Internal Balance, carrying out Game Transactions, as well as receiving, storing, upgrading, exchanging, withdrawing and automatically selling Items and performing other actions in respect of Items provided for by the functionality of the Platform.
1.3. This Agreement also applies to relations connected with the granting, crediting, use, restriction, cancellation and other disposal of bonuses, promo codes, rewards and other benefits provided by the Operator, as well as to any other relations directly arising from the User’s use of the Platform, unless the special terms of the relevant function expressly provide otherwise.
1.4. The Operator is the only party to this Agreement that provides the User with access to the Platform. The engagement by the Operator of third parties to ensure the operation of the Platform, including payment institutions, payment agents and providers, software suppliers and developers, operators of information infrastructure, hosting providers, identification and verification service providers, anti-fraud services, Steam bots and other contractors, does not make such persons parties to this Agreement and does not in itself create independent contractual relations between the User and such persons, unless expressly communicated otherwise to the User before the relevant transaction is carried out.
1.5. Functions actually performed by third parties in support of the Platform may be governed by separate terms of use, policies and other documents of those third parties. Where accepting such terms is required to use a function, the User reads them independently and decides whether to use the relevant third-party service.
1.6. The Platform is an independent internet service. Unless expressly stated otherwise by the Operator, the Platform, the Operator and persons related to the Operator are not affiliated with, authorised, sponsored or controlled by, or otherwise officially connected with Valve Corporation, Steam, the developers or right holders of the relevant computer games, or any other owners of trademarks and intellectual property mentioned on the Platform.
1.7. Names, trademarks, trade designations, images, interface elements, names of computer games and digital objects belonging to third parties are used on the Platform solely for informational and identification purposes, including to indicate compatible services, the relevant digital objects and their belonging to a particular computer game or third-party ecosystem, unless the relevant designation clearly indicates otherwise.
1.8. This Agreement applies together with the Privacy Policy, the Cookie Policy, the AML/KYC Policy, the rules of individual advertising and incentive campaigns, the special terms of individual Game Transactions, and other rules, policies and documents published by the Operator on the Website and expressly designated as governing the use of the Platform.
1.9. In the event of a conflict between the provisions of this Agreement and special terms set by the Operator for a particular function, promotion, bonus programme or type of transaction, the special terms prevail solely in respect of that function, promotion, programme or transaction. In all other cases the provisions of this Agreement apply, unless mandatory rules of applicable law provide otherwise.
1.10. No provision of this Agreement, nor the provision of access to the Platform, the existence of the Internal Balance or the possibility of carrying out transactions provided for by the Platform, shall be construed as an offer, provision or rendering by the Operator of banking, payment, investment, brokerage, dealer, depositary, insurance, trust or other regulated financial services, unless such qualification expressly follows from mandatory requirements of applicable law.
1.11. The Internal Balance is solely a technical and accounting indicator, provided for by the functionality of the Platform, of the scope of the possibilities available to the User within the Platform, and is not a bank account, deposit, electronic wallet or stand-alone financial product, unless expressly provided otherwise by applicable law.
1.12. The Operator does not accept the User’s money as a deposit, does not accrue interest or any other guaranteed income on the Internal Balance, and does not provide a separate service of keeping the User’s money solely for the purpose of its subsequent return or withdrawal, unless expressly provided otherwise by separate terms of the Operator and permitted by applicable law.
1.13. The display of any function, Top-up method, Game Transaction, Item or other possibility in the interface of the Platform does not in itself constitute an unconditional guarantee of its permanent or irrevocable availability to a particular User.
1.14. The Operator may, to the extent permitted by applicable law, set and change technical, territorial, age, operational, transactional, risk-based, compliance and other reasonable restrictions on the use of the Platform, including restrictions applying to individual Accounts, states and territories, payment methods, categories of Items, Game Transactions, limits and functionality.
1.15. Before starting and throughout the entire period of using the Platform, the User is solely responsible for making sure that the use of the Platform and of each particular function is permitted by the law applicable to the User, taking into account their citizenship, residence, location and other legally relevant circumstances.
1.16. The User undertakes to use the Platform solely in their own name and in their own interests, using an Account, payment instruments and third-party service accounts that belong to them or are lawfully at their disposal, unless otherwise agreed with the Operator expressly and in advance and provided this does not contradict applicable law.
1.17. The User’s use of a payment instrument, bank card, electronic wallet, Steam account, user account or other means of identification belonging to a third party, as well as carrying out transactions on behalf of or in the interests of a third party without the Operator’s prior permission where such permission is required, is a breach of this Agreement and may serve as grounds for applying the restrictive measures provided for herein.
1.18. The User is responsible for the accuracy of the information provided to the Operator and, at the Operator’s request in the cases provided for by this Agreement or applicable law, must confirm that the payment instruments, the Account and the related accounts used by them belong to them.
1.19. The headings of the sections, subsections and individual provisions of this Agreement are used solely for convenience of navigation and organisation of the text, have no independent normative meaning and may not be used to limit, change or extend the content of the relevant provisions.
1.20. Unless the content or substance of the relevant provision clearly indicates otherwise, terms used in this Agreement in the singular include the plural and vice versa, and a reference to a person includes their permitted successors to the extent such succession is allowed by the nature of the legal relationship and applicable law.
1.21. No provision of this Agreement is intended to exclude, limit or deprive the User of rights and guarantees granted to them by mandatory rules of applicable law that cannot be changed or waived by agreement of the Parties.
1.22. If any provision of this Agreement is held to be wholly or partly invalid, unenforceable or inapplicable by virtue of mandatory requirements of applicable law, this does not affect the validity of the remaining provisions of the Agreement, which continue to apply to the maximum extent permitted by law.
1.23. Where a provision of this Agreement admits several legally permissible interpretations, it shall be interpreted in the way that, to the greatest extent permitted by applicable law, preserves its validity, enforceability, original contractual purpose and the allocation of rights, obligations and risks between the Parties established by this Agreement.
1.24. The User confirms that they were given the opportunity to read this Agreement before starting to use the Platform. Continued use of the Platform after accepting the Agreement means the User agrees to comply with its rules throughout the entire period of using the Platform.
1.25. If the User disagrees with this Agreement in whole or in part or is unable to determine the legal consequences of accepting it on their own, the User must refrain from registering an Account, Topping Up the Internal Balance, carrying out Game Transactions and any other use of the functionality of the Platform.
Terms and definitions
For the purposes of this Agreement, the terms and definitions below have the meanings given to them unless a separate provision of this Agreement expressly provides otherwise or the substance of the relevant legal relationship or the context requires otherwise. Capitalised terms are used with the meanings set out in this section throughout the Agreement, including its annexes, special terms, policies and other documents of the Operator that form an integral part of it.
“Website” means the internet resource available at katenza.pro that belongs to the Operator and (or) is used by it to provide access to the functionality of the Platform, including, as applicable, its language and regional versions, domain names, subdomains, individual web pages, software and user web interfaces, and other electronic access points officially designated by the Operator. This definition does not cover websites, applications and other information resources of third parties that may be reached via hyperlinks or other technical means placed on the Website.
“Platform” means the set of software, hardware-software, information and technological means owned by, managed by or lawfully used by the Operator, including the Website, server and network infrastructure, databases, software modules, algorithms, user and software interfaces, transaction processing mechanisms, accounting systems and other service functions through which the User is given the opportunity to use the functionality provided for by this Agreement.
“Account” means the User’s individual account on the Platform, created and (or) activated in the manner established by the Operator, including by signing in with a Steam Account, and containing the set of accounting and technical information relating to the User, including information about the Internal Balance, the Inventory, completed transactions, applied restrictions, settings and other data provided for by the functionality of the Platform. The Account is a means of technical accounting and of providing access to the Platform and is not in itself a separate object of the User’s property rights.
“Steam Account” means an account in the Steam information and digital service that belongs to or is lawfully used by the User and through which, in the cases provided for by the Platform, the User is authorised, identified and (or) interacts with individual functions of the Platform. A Steam Account is created, maintained and governed by the relevant documents, rules and technical requirements of Valve Corporation and (or) other persons managing Steam, does not belong to the Operator and is not under its technical or legal control.
“Internal Balance” means a technical accounting indicator, formed and recorded by the information systems of the Platform, of the number of conventional units available to the User for carrying out the transactions provided for by the functionality of the Platform. The Internal Balance is intended solely for internal accounting and the use of the functionality of the Platform and, unless mandatory rules of Applicable Law expressly provide otherwise, is not legal tender, currency, foreign currency, electronic money, digital currency, cryptocurrency, a payment instrument, a bank account, a bank deposit, a deposit, a security, a financial instrument or any other stand-alone financial asset, and does not in itself certify an unconditional monetary claim of the User against the Operator for payment of the corresponding amount of money.
“Top-up” means a transaction carried out by the User using one of the payment methods available at the relevant time, aimed at increasing the Internal Balance by the number of conventional units determined by the Platform in accordance with the terms displayed to the User before the transaction is confirmed. A Top-up is not a deposit of money into a bank account or a bank deposit and does not create an obligation of the Operator to accrue interest or any other return on the amount of the Internal Balance.
“Game Transaction” means an action initiated and confirmed by the User to use a particular functional or game mechanic of the Platform, the result of which is generated, determined and (or) recorded by the software and hardware of the Platform in accordance with the parameters of the relevant function and reflected in the User’s Account. Game Transactions include, in particular, an Upgrade, a Contract and other functional mechanics available at the relevant time that involve obtaining a digital result.
“Upgrade” means a functional mechanic provided by the Platform through which the User may use one or more Items, conventional units of the Internal Balance or a permitted combination of them to obtain another Item in accordance with the parameters and terms displayed before the transaction is confirmed. The estimated value of the result may be higher than, comparable to or lower than the total estimated value of the Items and (or) conventional units used; an Upgrade does not involve their simple arithmetic addition and does not guarantee a result of any particular value.
“Contract” means a digital service mechanic provided for by the functionality of the Platform that allows the User to combine, make available for use and (or) otherwise engage, in the manner provided by the interface, a set number of Items meeting the requirements of the Platform in order to generate a new digital result on the terms and in accordance with the parameters displayed to the User before the transaction is finally confirmed.
“Item” means a digital object displayed visually and (or) informationally through the interface of the Platform, related to game content, the relevant computer game and (or) the Steam infrastructure and identified by a set of characteristics provided for by the relevant information systems. Unless mandatory requirements of Applicable Law provide otherwise, an Item is not money, electronic money, a security, a financial instrument or any other regulated financial asset. The possibility of owning, using, transferring, exchanging and performing other actions with an Item is determined, in addition to this Agreement, by the technical capabilities and rules of Steam, the relevant computer game and other applicable third-party services that are not under the Operator’s control.
“Inventory” means the dedicated section of the Account and the corresponding set of server records through which the Items recorded by the Platform as available to a particular User are displayed until they are used in a Game Transaction, Withdrawn, exchanged, sold by Automatic Sale or otherwise written off, removed from display or have their accounting status changed as provided for by this Agreement. The display of an Item in the Inventory is not in itself an unconditional guarantee that it can technically be transferred via Steam at any time.
“Withdrawal” means a technical procedure initiated by the User through the functionality provided by the Platform, aimed at transferring the relevant Item to the Linked Steam Account using the available technical mechanisms of Steam and (or) related services, provided that the User complies with the requirements of this Agreement, passes the necessary checks, and there are no technical, legal, compliance, anti-fraud, sanctions or other restrictions on the part of the Operator, Steam or the relevant third parties. Initiating a Withdrawal does not guarantee its successful completion where the execution of the transaction depends on the infrastructure or actions of third parties.
“Linked Steam Account” means the Steam Account through which the User was signed in to the Platform at the time of the relevant Game Transaction and which the information systems of the Platform recorded as the account linked to the User in respect of the Item obtained as a result of that Game Transaction. Unless the Operator expressly provides otherwise, a change by the User of the linked Steam account after receiving the Item does not automatically change the Steam account to which that Item may be Withdrawn.
“Automatic Sale” means an automated service transaction provided for by this Agreement and carried out by the information systems of the Platform without the need for additional confirmation by the User at the moment it is carried out, as a result of which an Item not Withdrawn by the User within the period set by the Agreement or the interface of the Platform is removed from the Inventory and is no longer recorded there as available for Withdrawal, and the User’s Internal Balance is credited with the number of conventional units determined by the Platform in accordance with the rules and parameters applicable at the time of such transaction. Automatic Sale may be applied only if the relevant mechanism and the essential terms of its application have been properly brought to the User’s attention.
“Server Data” means the set of electronic and technical information generated, received, recorded, processed and stored by the Operator’s information systems relating to the operation of the Platform and the User’s actions, including event and transaction logs, unique transaction and request identifiers, timestamps, information about the sequence of actions, technical parameters of requests and responses, Account data, information about the state of the Internal Balance and the Inventory, results of Game Transactions, information about technical errors and other information necessary for the operation, security, audit and resolution of disputes in respect of the Platform.
“Technical Error” means a deviation from the intended normal operation of the software, algorithms, server, network or other infrastructure of the Platform that objectively exists and is confirmed by the Operator on the basis of Server Data and (or) other available technical information, and that directly resulted in the duplication of a transaction, its failure to be properly executed, an incorrect debit or credit, a distortion of the result or other technically erroneous recording of a transaction in the information systems of the Platform. A change in the market, estimated or other value of an Item, a result not meeting the User’s subjective expectations, the absence of an expected economic benefit, a change in the terms or restrictions of Steam, the temporary unavailability of a third-party service or any other circumstance not caused by a disruption of the normal operation of the Platform is not in itself a Technical Error.
“Applicable Law” means the law of the Kyrgyz Republic to the extent chosen by the Parties as the law governing this Agreement and the relations arising from it, as well as any mandatory rules of the law of another jurisdiction that, by virtue of the relevant conflict-of-law rules, the User’s status, location, the nature of a particular transaction or other legally relevant circumstances, must be applied regardless of the law chosen by the Parties.
Unless the context of this Agreement clearly indicates otherwise, terms derived from the definitions above shall be interpreted in the meaning corresponding to the main defined term. Technical, commercial or other designations that have not been separately defined in this section are interpreted taking into account the content of this Agreement, the actual functionality of the Platform and, where applicable, the generally accepted meaning of the relevant terms.
2. Acceptance of the Agreement
2.1. This Agreement becomes binding on the User from the moment they perform an action that, in accordance with the interface used on the Platform and the requirements of Applicable Law, unambiguously indicates acceptance of the terms of the Agreement, including registering an Account, signing in to the Platform, ticking the relevant box (checkbox) in the field provided by the interface, pressing a confirmation button, confirming a particular transaction, Topping Up the Internal Balance, carrying out a Game Transaction or continuing to use the Platform after the User has been given the opportunity to read the current version of the Agreement.
2.2. Where Applicable Law requires a separate, explicit consent of the User to the terms of this Agreement or to individual provisions of it, the Agreement is accepted solely through an active confirming action provided by the Platform that meets the requirements of the relevant law.
2.3. By performing an action aimed at accepting this Agreement, the User represents and warrants that before such acceptance they had access to the full text of the Agreement, carefully read its content, and understand the legal nature of the relations arising between the Parties, the main economic and technical principles of the operation of the Platform, the nature of Game Transactions and the consequences of carrying them out.
2.4. The User confirms that before accepting this Agreement they were given a reasonable and technically available opportunity to read its provisions, to refuse to register and use the Platform if they disagree with them, and to save, reproduce or otherwise obtain a copy of the text of the Agreement for later reference.
2.5. By accepting this Agreement, the User gives full, unconditional and unreserved consent to comply with its terms throughout the entire period of using the Platform, except for those provisions whose application is wholly or partly limited or excluded by mandatory rules of Applicable Law.
2.6. The User may not rely solely on the fact that they did not actually read the terms of this Agreement as grounds for being released from obligations arising from actions they performed after the text of the Agreement was properly made available, unless Applicable Law expressly provides otherwise.
2.7. Using the Platform, registering an Account, Topping Up the Internal Balance and carrying out Game Transactions are permitted only to natural persons who have reached the age of 18 (eighteen) and have the full legal capacity necessary to enter into and perform this Agreement on their own.
2.8. If the law of a state or territory whose rules must be applied to a particular User sets an age above 18 (eighteen) for the lawful use of the relevant digital, entertainment, gaming or comparable services or of individual mechanics provided by the Platform, that higher age is the minimum permitted age for such User.
2.9. The User represents to the Operator that at the time of registering the Account and throughout the entire period of using the Platform they meet the applicable age requirements, have the necessary legal capacity and are entitled, on their own and without the consent of parents, guardians, custodians or other legal representatives, to enter into this Agreement and assume the obligations provided for by it.
2.10. A person who has not reached the minimum age established by this Agreement and (or) Applicable Law may not register or use an Account, Top Up the Internal Balance, carry out Game Transactions, use Items or otherwise access the functionality of the Platform, and must immediately stop using the Website.
2.11. The Operator may at any time, including before granting access to individual functions of the Platform or after their use has begun, request from the User information and documents reasonably necessary to confirm their age, identity, legal capacity and compliance with the other admission criteria established by this Agreement.
2.12. The Platform is not intended to be offered, distributed or used in states and other jurisdictions where the provision or use of the relevant functionality, including mechanics for obtaining a digital result that is not determined in advance, carrying out Game Transactions, trading in game Items or other transactions provided for by the Platform, is prohibited, significantly restricted or requires a licence, permit, registration, approval or other regulatory status that the Operator does not have.
2.13. Whether a particular User may use the Platform is determined taking into account all the legal requirements applicable to them, including, depending on the circumstances, the law of the state of their actual location, permanent or temporary residence, citizenship, tax or other residence, as well as requirements related to the payment instrument they use and the nature of the particular transaction.
2.14. Before registering an Account and before each relevant transaction, the User must independently make sure that access to the Platform and use of the relevant function are not prohibited or restricted by the legal rules applicable to them, and that carrying out the relevant actions does not require the User or the Operator to obtain an additional permit that is lacking at the time of the transaction.
2.15. The Operator does not provide the User with individual legal, tax, financial or other professional opinions on whether the use of the Platform is permitted in a particular jurisdiction. Information published on the Platform about the territorial availability of individual functions is of a general informational nature and does not release the User from the obligation to comply with Applicable Law.
2.16. The mere technical possibility for the User to access the Website from a particular state or region, the absence of automatic IP address blocking, the possibility of registering or signing in, the existence of a corresponding language version of the interface, the display of a particular currency symbol, the availability of a particular payment method or the possibility of initiating a particular transaction does not constitute a representation, warranty, legal opinion or other confirmation by the Operator that the use of the Platform by the relevant User is unconditionally lawful in the relevant jurisdiction.
2.17. The User is prohibited from taking actions aimed at circumventing age, territorial, sanctions, compliance, payment, anti-fraud or other restrictions on access to the Platform or to its individual functions established by the Operator or third parties.
2.18. In particular, the User is prohibited from using VPN services, proxy servers, means of spoofing or masking an IP address, technologies for changing or falsifying geolocation data, third-party credentials, fictitious information about their place of residence or location, or any other software, technical or organisational means if the purpose or actual result of their use is to conceal the User’s real location or to circumvent the restrictions applicable to them.
2.19. The Operator may use technical and organisational means of determining and checking whether serving the User is territorially permissible, including analysis of IP addresses, geolocation and other technical signals, information about payment instruments, the results of identification and verification procedures, and other risk-based methods to the extent permitted by Applicable Law and the Operator’s documents on personal data protection.
2.20. The Operator may introduce, change, extend, reduce or cancel lists of territories and categories of Users for whom the use of the Platform or its individual functions is restricted, if such measures are required by law, regulatory risks, sanctions restrictions, requirements of payment institutions or other counterparties, the prevention of abuse or other reasonable legal, technical or commercial circumstances.
2.21. If it is impossible to reliably establish the User’s age, identity, location, country of residence, the legal regime applicable to them or other circumstances that are material to determining whether a particular function may be provided, the Operator may temporarily restrict or suspend access to individual transactions until the necessary checks are completed.
2.22. If, after the User has started using the Platform, the relevant activity becomes prohibited or restricted for the User due to changes in legislation, regulatory practice, the sanctions regime, the Operator’s territorial policy or other legally relevant circumstances, the User must immediately stop initiating new transactions, using the restricted functions and any actions contrary to the relevant requirements.
2.23. In the circumstances provided for in clause 2.22 of this Agreement, the procedure for settling the previously formed Internal Balance, Items, incomplete transactions and other accounting positions existing at the time the restriction is introduced is determined by the Operator taking into account the requirements of Applicable Law, the technical feasibility of the relevant actions, mandatory requirements of payment institutions, Steam and other third parties, and the need to carry out the checks provided for by law or this Agreement.
2.24. The termination or restriction of the User’s access to the Platform on territorial, age, sanctions, compliance or other grounds provided for by this Agreement does not automatically give the User the right to demand a transaction that is technically impossible, prohibited by law or restricted by third parties.
2.25. The Platform is intended solely for the User’s personal, non-commercial use, unless otherwise agreed with the Operator in writing in advance and expressly.
2.26. Without the Operator’s prior written consent, the User is prohibited from using the Platform in the course of business or other professional activity, including the systematic resale of Items, managing the money, Internal Balance, Accounts or Items of third parties, providing intermediary, agency, trust or similar services, organising shared use of an Account or any other activity aimed at systematically generating income through the functionality of the Platform.
2.27. Before or after granting the User access to a particular function, the Operator may request documents, information and explanations reasonably necessary to confirm the User’s identity, age, country of residence or location, ownership of the payment instruments used, the economic nature of the transactions carried out, the source of money and (or) other assets, and other circumstances that must be checked to fulfil the requirements of Applicable Law, this Agreement, the AML/KYC Policy or the Operator’s internal risk management procedures.
2.28. The User must provide the information and documents requested in accordance with this Agreement in an accurate, up-to-date, complete and undistorted form and may not provide knowingly false or misleading information or information relating to a third party in order to pass the relevant check.
2.29. The User’s failure to provide reasonably requested information or documents, the provision of incomplete or contradictory information, the impossibility of confirming its accuracy, or the discovery of circumstances requiring additional checks may be grounds for temporarily suspending individual transactions, restricting the functionality of the Account or refusing to carry out a particular transaction until the relevant check is completed, to the extent permitted by Applicable Law.
2.30. The User is solely responsible for complying with the legal requirements applicable to them when using the Platform. At the same time, no provision of this section releases the Operator from the obligations and restrictions imposed directly on it by mandatory rules of Applicable Law that cannot be transferred to the User by agreement of the Parties.
3. Account and access security
3.1. To access the main functionality of the Platform, the User must sign in with a Steam Account that belongs to them in the manner provided by the relevant interface. Unless otherwise permitted by the Operator in writing, expressly and in advance, one User may create and use only one Account. The creation, registration, actual use or control of several Accounts by one User, including through different Steam Accounts, devices, IP addresses or other technical means, may be treated by the Operator as a breach of this Agreement.
3.2. The Account is individual and personal and is intended solely for use by the User to whom it belongs. The User is prohibited from selling, alienating, transferring, lending, sharing the Account with third parties or otherwise enabling third parties to act on the User’s behalf, including by transferring session identifiers, tokens, confirmation links, authorisation codes and other technical means of access. The User must use only a Steam Account of which they are the lawful owner and which they actually control; the Operator may request reasonably necessary information and evidence confirming such control.
3.3. The Steam identifier and other technical information recorded in the Server Data when the User signs in, carries out a Game Transaction or performs any other legally or technically significant action are used by the Operator to establish the link between the User, their Account, completed Game Transactions, Items received, the Inventory and Withdrawal requests. Unless the functionality of the Platform expressly provides otherwise, the relevant Server Data are the basis for determining which Account and Steam Account a particular transaction belongs to.
3.4. The User must independently ensure the confidentiality and security of all means through which access to the Account, the Steam Account or related functions can be obtained, including devices, Steam credentials, email, two-factor authentication tools, payment instruments, active user sessions and other identification or authentication data. If there is a reasonable suspicion that a device has been lost, credentials have been compromised, unauthorised access has occurred or actions have been performed by a third party, the User must immediately notify the Operator through the communication channels provided by the Platform.
3.5. Until the Operator actually receives the User’s notice of a suspected compromise of access, actions performed after successfully passing the sign-in procedure provided by the Platform and confirmed by the Server Data are presumed to have been performed by the User or with their knowledge and consent, unless otherwise established on the basis of the totality of objective circumstances. This provision does not apply to the extent that such a presumption or the allocation of risk to the User would contradict mandatory rules of Applicable Law.
3.6. In order to ensure the security of the User and the Platform and to prevent fraud, unauthorised access and other abuse, the Operator may temporarily restrict individual functions of the Account, suspend Game Transactions and (or) Withdrawals, and require an additional check where it detects an atypical change of geographical location, device or network parameters, a significant change in payment behaviour, the use of a different Steam Account, multiple failed sign-in attempts, signs of the use of several Accounts or other circumstances objectively indicating an increased risk of compromise or breach of this Agreement.
3.7. Restoring access to the Account, lifting security restrictions and confirming the User’s authority are carried out in accordance with the security procedures established by the Operator and may involve checking the Steam profile, the history of sign-ins and transactions, information about previously used payment instruments, technical parameters of devices, identity documents and other reasonably necessary information. The Operator may withhold full access until it has sufficient grounds to believe that the Account is returning to the control of the proper User.
3.8. A Steam Account recorded in the Server Data as the Linked Steam Account in respect of a particular Item or Game Transaction cannot subsequently be replaced at the User’s sole initiative in respect of Items already received. A change of the sign-in method or of the linked Steam account, where technically provided for by the Platform and permitted by the Operator, applies only to future transactions and does not change previously generated Server Data, the attribution of the results of completed transactions or the details set for the Withdrawal of previously received Items.
3.9. Before confirming each Game Transaction, the User must independently check that the Steam Account used for the current sign-in is the correct one. Carrying out a Game Transaction after mistakenly signing in with a different Steam Account does not in itself oblige the Operator to change the Linked Steam Account or to move Items, the Internal Balance, results of Game Transactions or other accounting positions between Accounts, unless such a transfer is provided for by the functionality of the Platform or by mandatory requirements of Applicable Law.
3.10. For the purposes of information security, the prevention of abuse, compliance with established limits and restrictions, AML/KYC and anti-fraud checks and the investigation of suspected breaches of this Agreement, the Operator may compare and jointly analyse information about Accounts that show objective signs of a technical, payment or other connection. Establishing such a connection does not oblige the Operator to merge the Accounts, Internal Balances, Inventories, Items or other accounting positions of the relevant persons.
3.11. Creating or using a new Account after a temporary restriction, blocking or termination of an Account previously used by the User, without the Operator’s prior written permission, is treated as circumvention of the applied measure and is a separate breach of this Agreement. In such a case the Operator may apply the restrictions provided for by this Agreement to the newly discovered Account, taking into account the nature of the breach, the results of the check carried out and the requirements of Applicable Law.
3.12. The User must ensure that the contact and other information provided to the Operator is accurate and up to date and update it promptly where technically possible. The risk of not receiving notifications because the User provided inaccurate or outdated information is borne by the User, except where Applicable Law expressly places the relevant risk or the obligation of proper delivery on the Operator. The Operator does not ask the User for their Steam password; the User’s disclosure to third parties of a password, two-factor authentication codes, tokens, confirmation codes or other confidential means of full access to the Steam Account breaches security requirements and may be grounds for the Operator to apply a temporary protective block until the circumstances are clarified and proper control over the Account is confirmed.
4. Item Upgrades and how the game result is generated
4.1. An Upgrade is a Game Transaction in which the User uses one or more selected Items, conventional units of the Internal Balance or a permitted combination of them in order to obtain another Item. Before confirming the transaction, the User must review the source Items shown in the interface, their number and estimated value, the target or other intended result, the applicable probability indicator where displayed, and the other essential parameters of the Upgrade.
4.2. The result of an Upgrade is generated by the software and hardware of the Platform and, once the Game Transaction is confirmed, is recorded in the Operator’s Server Data. The Server Data are legally and technically decisive for establishing that the transaction took place, which Items were used and what result was generated, unless otherwise established as a result of a confirmed Technical Error. Visual effects, animation, graphics, sound and other interface elements are purely informational and visual and do not in themselves determine or change the result.
4.3. The total estimated value of the Items and (or) conventional units used for an Upgrade is not a promise that the value will be preserved, added up arithmetically or increased. The Item generated as a result of an Upgrade may have an estimated value higher than, comparable to or lower than the total estimated value of the assets used. The display of a target Item, an estimated value, a percentage or any other parameter only describes the particular transaction at the moment it is confirmed and is not a guarantee of any particular economic result.
4.4. An interruption or incorrect display of the visual part of an Upgrade, including stopping or speeding up the animation, reloading the page, closing the browser or application, navigating to another page, ending the user session, a temporary loss of the internet connection, delayed loading of the interface or any other display-side failure, does not in itself cancel or annul the Game Transaction if the Server Data reliably confirm the correct debiting of the assets used and the proper generation of the result. Until the result is recorded, the User does not acquire the right to demand any particular Item.
4.5. The User understands and accepts that the value, estimated valuation, demand, rarity and other economically significant characteristics of the Item generated as a result of an Upgrade may differ significantly from the total value of the Items and conventional units used. When the Platform operates correctly, such a result is not a Technical Error and, except in the cases expressly provided for by Applicable Law, does not entitle the User to demand payment of the difference, return of the assets used, a repeat of the transaction, replacement of the result or compensation for an assumed or expected value.
4.6. The Operator may change, solely for future Game Transactions, the list and characteristics of Items eligible for Upgrades, the ranges of estimated value, probability indicators, visual design, functional parameters and other terms of the relevant mechanic. Such changes do not apply to properly completed Game Transactions. If, before a transaction is finally completed, the information in the interface objectively differs from the Server Data, the Operator may suspend the transaction for a check and, depending on its results, restore the debited assets or execute the transaction on the terms reliably recorded in the Server Data and communicated to the User before confirmation.
4.7. For individual Upgrade modes, advertising, bonus or other campaigns, the Operator may set additional conditions and special rules, provided that the User is given the opportunity to read them before confirming the transaction. Information about the results of previous Upgrades of the User or third parties, statistical indicators, counters, advertising and demonstration materials and examples of Items obtained are not an individual forecast, representation or guarantee of the result of a subsequent transaction. The Upgrade functionality is not offered by the Operator as a way of earning guaranteed income, price arbitrage or professional trading in Items.
4.8. Where there are objective grounds to believe that the result of an Upgrade was generated, changed, duplicated or obtained as a result of a Technical Error, software or technical interference, a repeated submission of a request, unauthorised interference with the Platform, exploitation of a vulnerability or other actions that disrupt the normal operation of the Platform, the Operator may temporarily suspend the Withdrawal, exchange, Automatic Sale or other disposal of the relevant Item for the period of a technical check. Depending on the results of the check, the Operator may restore the correct accounting state, cancel an erroneously duplicated result or return wrongly debited assets; such measures must not be used to arbitrarily change the result of a correctly completed Game Transaction.
5. Game functions
5.1. The essential parameters of an Upgrade, including the Item or set of Items used by the User, the number of conventional units of the Internal Balance to be used, the target Item and other characteristics and conditions provided for by the relevant game mechanic, are displayed in the interface of the Platform before the Game Transaction is finally confirmed. The User must independently check these parameters before performing the confirming action; continuing the transaction after the relevant information has been provided means the User agrees to the terms displayed for that transaction.
5.2. By confirming an Upgrade, the User gives the Operator an instruction, irrevocable within the relevant Game Transaction, to debit the Items selected and shown in the interface and (or) the corresponding number of conventional units of the Internal Balance in order to generate the result of the Upgrade in accordance with the parameters in force and communicated to the User at the time of confirmation. Once the result has been properly generated, such debiting is final, except in the case of a confirmed Technical Error or other grounds expressly provided for by Applicable Law.
5.3. The User understands and accepts that an Upgrade ends with the generation of the result provided for by the parameters of the particular transaction, and that this result may differ from the selected or visually presented target Item and its estimated value may be lower than, comparable to or higher than the total estimated value of the Items and conventional units used. An economically unfavourable result for the User while the Platform operates correctly is not a Technical Error and does not in itself entitle the User to demand the return of the assets used, a repeat of the transaction, replacement of the result or payment of compensation.
5.4. If, for a particular Upgrade or other Game Transaction, the interface of the Platform displays a numerical, percentage or other indicator of the probability of a certain result, that indicator relates solely to that particular transaction and the parameters generated immediately before the User confirms it. The indicator is not a promise that the result will actually occur, does not guarantee the successful completion of the transaction and does not determine the result of any previous or subsequent Game Transactions. Each such transaction is considered separately in accordance with the parameters applicable at the time of its confirmation.
5.5. A Contract is deemed initiated and confirmed by the User once the User has selected the number of eligible Items provided by the interface, reviewed the displayed parameters and performed the confirming action provided by the Platform. Once the result of the Contract has been correctly generated, the Items used for it are finally debited from the Inventory and are no longer available for Withdrawal, exchange, Automatic Sale, reuse or any other transactions. Obtaining the result of a Contract does not give the User the right to demand the return of the Items used, except in the case of a confirmed Technical Error or where such an obligation exists by virtue of Applicable Law.
5.6. The User accepts that the value, estimated valuation, market price, rarity and other economic characteristics of the result of an Upgrade, a Contract or another Game Transaction may differ, including significantly, from the total value of the Items and conventional units used for that transaction. Provided the Game Transaction was executed correctly, such a difference is a permissible property of the relevant game mechanic and does not constitute a debt of the Operator to the User, is not a Technical Error and does not give rise to a right to demand reimbursement of the difference, an additional payment, replacement of the result or any other compensation, unless mandatory rules of Applicable Law expressly provide otherwise.
5.7. For future Game Transactions, the Operator may set and change requirements, criteria and restrictions for Items and other accounting units eligible for use in an Upgrade, a Contract or another game function, including restrictions on quantity, category, type, rarity, estimated value, time or method of receipt, origin, period of holding in the Inventory and other objectively determinable characteristics. The Operator may also set minimum and maximum transaction values, time intervals, quantitative limits and other technical parameters of the relevant functions.
5.8. Before confirming an Upgrade, a Contract or another Game Transaction, the User must independently check that the selected Items, their number, the displayed parameters of the transaction, the number of conventional units to be debited, the target Item and other essential characteristics are correct. An erroneous, accidental or careless choice by the User, including the use of an Item that the User subjectively considers rarer, more valuable or economically more significant, is not a Technical Error and is not grounds for cancelling, changing or reversing a correctly completed Game Transaction.
5.9. In order to ensure the stable and secure operation of the Platform and to prevent accidental duplication of transactions, automated or programmatic actions, exploitation of vulnerabilities, fraud and other abuse, the Operator may set technical pauses between transactions, quantity and value limits, additional confirmation steps, time restrictions, re-authentication procedures, security checks and other proportionate protective mechanisms. The existence of such measures does not in itself mean that the User has a right to carry out Game Transactions without restrictions or in any predetermined volume.
5.10. Functionality of the Platform expressly designated by the Operator as test, experimental, temporary, seasonal, promotional or provided in a limited mode may be changed, suspended or discontinued by the Operator for future use. Unless caused by a Technical Error, the requirements of Applicable Law or the need to remedy the consequences of a breach of this Agreement, the discontinuation or change of the relevant function does not affect the results of Game Transactions properly completed before the change takes effect.
5.11. When new game mechanics or other functionality not expressly named in this Agreement are introduced, the relations arising from their use are governed, to the relevant extent, by the general provisions of this Agreement on the Internal Balance, Items, the generation of a result not individually determined in advance, Server Data, Technical Errors, Account security, prohibitions and restrictions on the use of the Platform, dispute resolution and the liability of the Parties, unless the special terms of the relevant function provide otherwise.
5.12. Where there are objective signs that an Upgrade, a Contract or another Game Transaction was carried out, or its result was generated, as a result of a Technical Error, duplication of a request, software interference, the use of automated means, exploitation of a vulnerability or another disruption of the normal operation of the Platform, the Operator may temporarily restrict the disposal of the relevant Items and (or) other results of the transaction for the period of the check. Depending on the results of the check, the Operator may restore the correct state of the accounting data and apply other measures provided for by this Agreement; a correctly generated result is not subject to arbitrary cancellation or change merely because it is economically unfavourable for the Operator or the User.
6. Items, the Inventory and the legal status of digital objects
6.1. The display of an Item in the Inventory and the existence of the corresponding record in the information systems of the Platform confirm only that the User has the possibility, provided for by this Agreement, to perform the actions available at the relevant time in respect of that Item through the functionality of the Platform, including using it in Game Transactions, Withdrawing it or otherwise disposing of it as provided for by the Agreement. Such a record does not in itself certify that the User has acquired ownership, an exclusive right or any other absolute property right to the software code, graphic image, design, trademark, name, audiovisual elements or other intellectual property related to the relevant Item.
6.2. The legal regime of Items related to computer games, Steam and other third-party digital services is determined not only by this Agreement but also by the applicable rules, user agreements, licence terms, technical restrictions and other mandatory requirements of Valve Corporation, the right holder of the relevant computer game and other third parties. The Operator is not entitled to, and does not undertake to, grant the User a greater scope of rights, powers or technical possibilities in respect of an Item than the relevant third-party service and Applicable Law allow.
6.3. Until a Withdrawal is successfully completed, the Item is recorded and displayed by the internal information systems of the Platform in accordance with the Server Data. The presence of an Item in the Inventory is not in itself a guarantee of its immediate or unconditional transfer to the Linked Steam Account, since the possibility and timing of such a transfer may depend on the availability and rules of Steam, the Item being in a state technically available for transfer, the operation of Steam bots, trading restrictions, trade hold periods, maintenance of third-party services and other circumstances wholly or partly beyond the Operator’s reasonable control.
6.4. In the absence of restrictions established by this Agreement, Applicable Law, the rules of Steam or reasonable restrictions applied by the Operator, the User may, within the available functionality, use an Item in an Upgrade, a Contract or another Game Transaction, initiate its Withdrawal or keep the Item in the Inventory until the grounds for Automatic Sale provided for by this Agreement arise. Using an Item in an Upgrade, a Contract, an exchange or another transaction that consumes it means that the User agrees to the final debiting of that Item once the result of such transaction has been properly generated.
6.5. The Operator may temporarily suspend the Withdrawal, use, exchange, Automatic Sale or other disposal of a particular Item where there are objective grounds for a check, including a dispute of the related payment, the initiation of a chargeback or payment refund procedure, the need to check the source of funds, signs of fraud or unauthorised access, a suspected Technical Error, restrictions imposed by Steam or the receipt of a binding demand of a court, state, law enforcement, supervisory or other competent authority. The duration of the relevant restriction is determined by the nature and circumstances of the check and should not exceed the time objectively necessary to carry it out, unless a different period results from the law or the actions of third parties.
6.6. The name, image, category, rarity, condition and other visual or descriptive characteristics of an Item are displayed by the Platform on the basis of information available to the Operator from its own and third-party information systems. Where individual visual elements of the interface differ from the technical information about the Item, the decisive factors for identifying the particular digital object are its unique identifier and other objective technical characteristics confirmed by the totality of the Server Data and Steam data. An obvious display error that did not affect the identity of the digital object actually generated does not in itself entitle the User to demand a different Item, unless Applicable Law provides otherwise.
6.7. The Operator does not set or guarantee that any particular market, exchange, estimated or other value of an Item will be maintained after the User receives it, that there is or will continue to be demand for the Item, its liquidity, the possibility of its subsequent sale, exchange or transfer to a third party, or that the rules of its circulation or its technical availability in Steam will remain unchanged. The value of and demand for Items may change due to market conditions, decisions of Valve Corporation and of the developers and right holders of the relevant games, changes in the characteristics of game objects and other circumstances outside the Operator’s control.
6.8. The Inventory is not a service of indefinite storage of digital objects, and the Operator does not undertake to keep an Item in the Inventory for an indefinite period solely so that the User can wait for a change in its assumed market value. The maximum period an Item may stay in the Inventory, the consequences of the expiry of that period and the terms of Automatic Sale are determined by this Agreement and (or) special rules properly brought to the User’s attention.
6.9. If support for a particular computer game, category of Items or the relevant integration with Steam or another third-party service ends or changes significantly, or if circumstances arise that objectively prevent the further provision of the relevant functionality, the Operator may restrict or stop future transactions with the relevant Items. In respect of Items already shown in the Inventory, the Operator may, depending on technical feasibility and the requirements of Applicable Law, give the User a reasonable period for an available Withdrawal or apply the Automatic Sale mechanism provided for by this Agreement.
6.10. The User alone bears the risk of changes in the value, liquidity, demand and technical availability of an Item after receiving it, as well as the risk of Steam, the right holder of the relevant game or another third party introducing new restrictions on the use, transfer or exchange of the relevant digital object. This provision does not release the Operator from liability for its own improper performance of obligations where such liability cannot be excluded or limited under Applicable Law.
6.11. The User independently determines and fulfils the tax, declaration, registration and other public-law obligations arising directly for them in connection with the receipt, use, transfer, exchange, Withdrawal or other disposal of Items, in accordance with the law of the jurisdiction applicable to them. The Operator does not provide the User with individual tax advice and is not obliged to pay the relevant taxes, fees or other mandatory payments on the User’s behalf, except where the obligation to calculate, withhold, declare or transfer them is expressly and mandatorily imposed on the Operator by Applicable Law.
6.12. DEMO mode. The Platform may provide an Account with two separate modes: demonstration (DEMO) and real (REAL). Each mode has its own Internal Balance, its own Inventory and its own transaction history; the current mode is selected in the interface of the Platform. The Operator may open the REAL mode in stages, for individual Users, or temporarily restrict access to it.
6.13. Coins, Items and other results recorded in the DEMO mode (“DEMO assets”) are virtual records of the Platform. They have no monetary, property or other value, are not money, electronic money, digital currency or digital financial assets, are not Items eligible for Withdrawal and do not belong to the User as property. Prices and values displayed in the DEMO mode are purely informational.
6.14. DEMO assets cannot be Withdrawn, including to the Linked Steam Account, exchanged for money, Items or the balance of the REAL mode, transferred to the REAL mode, sold, transferred or otherwise disposed of outside the game mechanics of the Platform. Topping Up the Internal Balance with real money and Withdrawals are not carried out in the DEMO mode.
6.15. The Internal Balance of the DEMO mode is topped up free of charge within the limits and on the terms displayed in the interface of the Platform and in the Platform’s Telegram bot, including through free top-ups, a daily bonus, coupons for inviting friends, giveaways and leaderboard rewards. Prizes and rewards drawn or credited in the DEMO mode are credited in the DEMO mode only.
6.16. The parameters of game mechanics in the DEMO mode, including probabilities, the return rate and fees, may differ from the parameters of the REAL mode. The results of transactions in the DEMO mode are not a forecast, representation or guarantee of the results of transactions in the REAL mode.
6.17. The Operator may at any time change the limits and mechanics of the DEMO mode and adjust or reset DEMO assets, including in the event of a Technical Error, abuse, the use of several Accounts or automated means, or when testing of the Platform ends or restarts. Since DEMO assets have no value, such actions do not give the User a right to demand compensation.
7. Withdrawal of Items
7.1. The Withdrawal functionality is provided only for Items for which this possibility is technically available and not restricted by this Agreement, Applicable Law, the rules of Steam or other applicable requirements. The Internal Balance and the conventional units recorded on it are not subject to Withdrawal and, unless mandatory rules of Applicable Law expressly provide otherwise, cannot be exchanged, redeemed or paid out in the form of money, electronic or digital currency, cryptocurrency, electronic money or any other payment or financial instrument.
7.2. A particular Item may be Withdrawn only to the Linked Steam Account through which the User was properly signed in to the Platform when carrying out the Game Transaction that directly resulted in receiving that Item. The identifier of that Linked Steam Account is recorded in the Server Data at the time of the relevant Game Transaction and, unless Applicable Law or the functionality of the Platform expressly provides otherwise, is the only permissible detail for the subsequent Withdrawal of that Item.
7.3. Transferring an Item to any Steam account other than the Linked Steam Account is not allowed, including where that Steam account also belongs to the User or belongs to their relative, representative, a purchaser of the Item, an intermediary or another third party. The Operator is not obliged to create, maintain or manually implement technical exceptions to the established Withdrawal procedure. A User’s request to Withdraw to another Steam account, to circumvent the restrictions set by Steam or to transfer an Item outside the interface provided by the Platform may be declined and, where there are objective signs of increased risk, may be grounds for an additional security check.
7.4. Before submitting a Withdrawal request, the User must independently ensure that all the technical and organisational conditions necessary to receive the Item via Steam are met, including providing a valid and correct trade link, properly configuring Steam Guard and other security tools provided by Steam, being able to receive and accept trade offers, and the absence of applicable trade holds, trade bans, inventory restrictions, account restrictions and other circumstances preventing the transfer of the Item. The Operator is not liable for the impossibility or delay of a Withdrawal directly caused by circumstances on the side of the User or Steam, to the extent such liability cannot be imposed on the Operator under Applicable Law.
7.5. By submitting a Withdrawal request, the User instructs the Operator to perform the actions provided for by the functionality of the Platform and technically available to transfer the relevant Item to the Linked Steam Account. A Withdrawal is deemed properly completed once the transfer is confirmed by the relevant Server Data and, where applicable, by Steam data. Submitting a Withdrawal request, generating a trade offer or a change of the transaction status in the user interface before technical confirmation of the transfer does not in itself mean that the Withdrawal is finally completed.
7.6. The time needed to execute a Withdrawal request depends on a combination of circumstances, including the operability and availability of Steam and its software interfaces, the existence and availability of the relevant Steam bots, the technical status of the particular Item, the restrictions applicable to its transfer, the need to carry out security checks, AML/KYC and anti-fraud procedures, and other circumstances wholly or partly beyond the Operator’s reasonable control. Any Withdrawal time displayed in the interface or communicated to the User that is not expressly designated as guaranteed is indicative and does not constitute an unconditional obligation to transfer the Item within that period.
7.7. If an Item corresponding to the result of a Game Transaction is temporarily unavailable at a Steam bot technically able to transfer it, or its transfer is temporarily impossible for other technical reasons, the Operator may postpone the execution of the request until the technical possibility of transfer is restored, return the Item to the available internal accounting of the Platform or offer the User another Item comparable in characteristics agreed by the Parties. Replacing an Item with another digital object without the User’s consent is not allowed, except where such a consequence is expressly provided for by Applicable Law.
7.8. The User must promptly take the necessary actions to accept a correctly generated trade offer within the period set by Steam or communicated to the User through the interface of the Platform. Failure to accept, rejection, cancellation or expiry of a trade offer for reasons beyond the Operator’s control may require the User to submit a new Withdrawal request. If, as a result of such circumstances, the Item continues to be recorded in the Inventory, the period of its stay in the Inventory provided for by this Agreement and the application of the Automatic Sale mechanism are not automatically suspended, unless the interface of the Platform or Applicable Law expressly provides otherwise.
7.9. In order to prevent Top-ups and the Internal Balance from being used solely as a mechanism for moving value in transit, and to manage payment, anti-fraud and other risks, the Operator may, where permitted by Applicable Law and where the relevant condition was properly brought to the User’s attention before the Top-up, set a mandatory requirement to reach a minimum volume of Game Transactions (“Game Turnover”) before Items purchased or obtained with the relevant Top-up can be Withdrawn. The amount of the required Game Turnover, the way it is calculated and the transactions counted towards it are determined by the rules of the Platform available to the User before the relevant Top-up.
7.10. If a Game Turnover requirement applies to a particular Top-up, each subsequent Top-up may create a separate additional amount of Game Turnover or increase the total outstanding amount in accordance with accounting rules communicated to the User in advance. Until the applicable requirement is met, the Operator may temporarily restrict the Withdrawal, exchange or any other method provided by the functionality for extracting value from the relevant results of transactions; however, outstanding Game Turnover does not in itself entitle the Operator to arbitrarily reduce or cancel a correctly formed Internal Balance or Items in the absence of another ground provided for by this Agreement or Applicable Law.
7.11. The Operator may temporarily suspend the execution of a Withdrawal request for the period objectively necessary to carry out an AML/KYC, sanctions, anti-fraud or other check provided for by law or this Agreement, confirm the User’s identity and their control over the Linked Steam Account, check the ownership or lawful use of a payment instrument, investigate the circumstances of a payment dispute or chargeback, check the source of funds, investigate a suspected Technical Error, unauthorised access or other breach, and comply with a binding demand of a court, state, law enforcement, supervisory or other competent authority.
7.12. The User acknowledges that the technical possibility of a Withdrawal depends on the infrastructure and rules of third parties. Fees, hold periods, trading restrictions, Steam Guard requirements, restrictions of a particular computer game, API changes, the end of support for individual Items or transfer methods and other conditions set by Steam, Valve Corporation, the right holders of the relevant games or other persons independent of the Operator apply in accordance with the rules of those persons and may change without the Operator’s involvement. The Operator does not guarantee that the relevant third-party infrastructure will remain unchanged or always available.
7.13. The Operator takes the Withdrawal actions provided for by this Agreement only through methods officially supported by the Platform and technically permissible. The Operator is not obliged to satisfy the User’s demands to carry out a transfer in breach of the rules of Steam, to circumvent technical, territorial, sanctions, compliance or other restrictions, to use transfer channels not provided by the Platform or to perform other actions that may lead to a breach of Applicable Law, the requirements of third parties or security requirements. The Operator’s refusal to carry out such a transaction is not in itself a breach of this Agreement, provided the refusal is based on an objectively applicable restriction.
8. Automatic Sale of Items
8.1. Every Item credited to the Inventory and not Withdrawn or otherwise used by the User in a manner provided for by this Agreement before the period established by this section expires is subject to Automatic Sale. The Automatic Sale mechanism is solely an internal functional and accounting procedure of the Platform intended to limit the period during which Items stay in internal accounting and to keep the relevant digital infrastructure working and, unless mandatory requirements of Applicable Law provide otherwise, is not a brokerage, dealer, commission, depositary, investment or trust management service or any other separate regulated financial activity.
8.2. By accepting this Agreement and carrying out a Game Transaction that results in an Item being credited to the Inventory, the User gives the Operator an advance instruction, effective for each such Item, to automatically remove the Item from the Inventory once the established period expires, without obtaining additional confirmation immediately before doing so, and to credit the Internal Balance with the number of conventional units determined in accordance with the rules of this section. Until the Automatic Sale actually takes place, the User may dispose of the Item in another available way, including initiating a Withdrawal or using the Item in a permitted Game Transaction, provided no restrictions apply.
8.3. Automatic Sale is carried out by an automated run of the relevant function once every calendar day at 00:00 Coordinated Universal Time (UTC+0). Only the server time of the Platform and the relevant Server Data are used to determine the time of the run and to calculate the periods provided for by this section. The User’s time zone, the local time and settings of their device, geographical location, seasonal clock changes, the transition to summer or winter time and other similar circumstances do not change the established Automatic Sale schedule.
8.4. Each scheduled automated run includes only those Items for which at least 24 (twenty-four) full hours have passed since they were credited to the Inventory by the time of the run. Because of the fixed daily run time, the actual period an Item stays in the Inventory before Automatic Sale is at least 24 hours and, when the mechanism operates normally, usually less than 48 hours. If 24 full hours have not yet passed by the first run after the Item was received, the Item is automatically carried over to the next scheduled run. Accordingly, an Item received shortly before 03:00 UTC+0 is not sold automatically a few minutes after it is received, and an Item received shortly after 03:00 UTC+0 may stay in the Inventory until the run that takes place one additional calendar day after the first skipped run.
8.5. The value of an Item for the purposes of Automatic Sale is determined at the moment the relevant transaction is actually executed, on the basis of the Platform’s internal valuation and the information available at that moment, which may include the value of the Item displayed on the Website, available market data, liquidity and demand indicators, the characteristics and condition of the Item, information from third-party services and other objectively applicable criteria used by the Operator. The Automatic Sale value may differ from the value of the Item at the time it was originally received, the value of the relevant Game Transaction, the price of a similar object on the Steam Community Market or third-party marketplaces, and the current or future value assumed by the User. In the absence of a Technical Error, such a difference does not in itself oblige the Operator to compensate the User for the difference.
8.6. From the moment the Automatic Sale is properly completed, the relevant Item is finally removed from the Inventory and is no longer available to the User for Withdrawal, Upgrade, Contract, exchange or other transactions, and the number of conventional units determined in accordance with clause 8.5 of this Agreement is credited to the Internal Balance. Such conventional units have the same internal accounting status and are subject to the same usage restrictions that this Agreement provides for other units of the Internal Balance: they cannot be separately withdrawn back in the form of money, cryptocurrency, electronic money or any other means of payment and can be used only through the available functionality of the Platform, including Upgrades, Contracts and other Game Transactions provided for.
8.7. The start or continuation of an Account check, restrictions imposed by Steam, the User’s failure to reach the established Game Turnover or any other circumstance preventing the Withdrawal of an Item does not in itself suspend the period provided for Automatic Sale, unless the Operator, the special terms of the relevant check or Applicable Law expressly provide otherwise. The User must take into account the established period an Item may stay in the Inventory when choosing how to dispose of it. After an Automatic Sale has been correctly completed, the User may not demand its cancellation, the restoration of the Item to the Inventory, a subsequent Withdrawal of the sold Item, the application of a previously existing value or payment of the difference between the actual Automatic Sale value and any other value assumed by the User, except in the case of a confirmed Technical Error or where such a right exists by virtue of mandatory rules of Applicable Law.
8.8. If the automated run provided for in clause 8.3 of this Agreement did not take place in whole or in part due to a Technical Error, temporary unavailability of infrastructure, maintenance or other objective technical circumstances, the Operator may carry out the Automatic Sale of the relevant Items at the nearest technically available run after the obstacles are removed. Such a delay does not in itself oblige the Operator to compensate for a change in the market, estimated or other value of the Item during the delay, unless Applicable Law expressly provides otherwise. The timestamps of the Server Data are decisive for determining when the Item was credited to the Inventory, when the 24-hour period expired and when the relevant run took place; the date and time displayed on the User’s device or in other third-party systems are purely informational.
9. Loyalty programmes
9.1. The Operator may, at its own discretion, develop, introduce, run, change and end bonus programmes, loyalty programmes, advertising and incentive campaigns, and provide promo codes, cashback, bonus conventional units, personal offers, rewards and other forms of incentive (together, “Bonuses”). A Bonus is an additional functional possibility of the Platform and does not constitute a separate paid service of the Operator, unless the special rules of the relevant offer expressly provide otherwise. The use of Bonuses is governed by this Agreement and by the special terms of the particular promotion, programme or offer brought to the User’s attention before they take part.
9.2. Bonuses, including conventional units credited under the relevant offer, are not money, electronic or digital currency, electronic money, a financial instrument or a separate property claim for payment of money, are not purchased by the User for a separate fee and have no guaranteed monetary value. Unless the special terms or mandatory rules of Applicable Law expressly provide otherwise, Bonuses cannot be Withdrawn, refunded, sold, assigned, gifted, transferred to another User or a third party, or exchanged for money, cryptocurrency or any other means of payment, and can be used only within the functionality and on the terms established by the Operator.
9.3. For each Bonus, the Operator may set any terms of its granting and use not prohibited by Applicable Law, including the activation and validity period, the minimum and (or) maximum Top-up amount, the required Game Turnover, the order in which conventional units are spent, the list of counted and excluded Game Transactions, restrictions on Upgrades, Contracts and Items, the territory, the maximum number of participants, User eligibility criteria, the personal nature of the offer, the frequency of participation, technical and payment requirements and other terms objectively related to the relevant programme. Failure to meet any mandatory condition may make it impossible to grant, use or keep the relevant Bonus.
9.4. The accounting and spending of Bonuses are determined by the technical logic of the Platform and the special rules of the relevant offer. Unless expressly shown otherwise in the interface or provided for by special terms, conventional units acquired by the User through a Top-up may be spent before bonus conventional units or in another order provided for by the Platform’s internal accounting algorithm. The User may not on their own demand a different debiting order, a redistribution of debits already made between different categories of conventional units or a retrospective change of the source of funding of a completed Game Transaction.
9.5. Unless the special rules expressly provide otherwise, the right to take part in a particular bonus or advertising offer is granted once per User. To prevent multiple participation, the Operator may take into account the totality of objective signs of technical or actual connection, including the Account, Steam Account, device, IP address and other network identifiers, payment instrument, contact details and other anti-fraud signals permitted by Applicable Law. Such matches may be grounds for an additional check but should not in themselves be treated as unconditional proof of a breach without regard to the totality of circumstances.
9.6. The User is prohibited from using Bonuses in a way that contradicts the purpose of the relevant offer, including creating or using additional Accounts, self-referrals, fictitious invitations, registering nominal participants, transferring the Account to third parties, coordinated actions of several Users, artificially generating Game Turnover, using automated means, exploiting Technical Errors or vulnerabilities, manipulating the terms of a promotion, initiating a chargeback or an unjustified payment refund after receiving a Bonus conditional on that payment, or performing any other actions whose main purpose or actual result is to obtain a Bonus or a related economic benefit while circumventing the established terms.
9.7. Where there are objective signs of possible abuse, the Operator may temporarily suspend the crediting, use or realisation of the relevant Bonus and the transactions related to it for the period of the check. At the Operator’s reasonable request, the User must provide the information and documents necessary to establish the circumstances of their participation in the relevant programme. Until the check is completed, the Operator may restrict the Withdrawal of Items or other disposal of the results of transactions to the extent such results are directly related to the Bonus under review and there is a reasonable risk of their unlawful receipt or alienation.
9.8. If the check confirms that the User breached the terms of the relevant promotion, loyalty programme or this Agreement, the Operator may, to the maximum extent permitted by Applicable Law, cancel the unused Bonus, cancel bonus conventional units credited as a result of the breach, adjust the results of Game Transactions directly and demonstrably funded by the wrongly obtained Bonus, and cancel other credits or benefits that are directly causally connected with the established breach. Such measures must be aimed at restoring the accounting position that would have existed without the abuse and do not entitle the Operator to arbitrarily write off the User’s accounting positions unrelated to the relevant breach.
9.9. The Operator may refuse to grant a Bonus, stop accepting new participants, change the terms or end a promotion, loyalty programme or other incentive offer early for future participation, unless special terms or Applicable Law provide otherwise. Such a change or ending does not in itself give the User grounds to claim a Bonus that was not properly credited before the relevant changes took effect. Rights acquired by the User for a separate fee that are not of a bonus nature cannot be cancelled merely because a promotion has ended, in the absence of a separate ground provided for by this Agreement or by law.
9.10. The Operator may set a validity period for a Bonus, after which an unused Bonus, bonus conventional units, increased cashback or any other benefit granted solely under the relevant programme automatically ends and may be removed from the Account without paying the User any monetary or other compensation, provided that the validity period and the consequences of its expiry were properly brought to the User’s attention before the relevant Bonus was received or activated.
9.11. Advertising banners, notifications, posts, emails, short descriptions of promotions and other marketing materials may contain an abridged statement of the terms of the relevant offer and must be read together with its full rules. In the event of a discrepancy between an abridged advertising description and the full rules, the full rules of the relevant promotion or programme prevail, provided that they were available to the User before the action required to take part, are set out in an accessible way and do not contain provisions whose application contrary to the advertising message would be misleading or otherwise prohibited by Applicable Law.
9.12. The granting of a Bonus to one or more Users, the repeated running of a particular promotion, the Operator making an exception in a particular case or not applying a measure provided for by this section does not give other Users the right to demand a similar Bonus, the continuation of the relevant programme in the future or the application of identical individual terms. The Operator retains the right to differentiate offers by objective commercial, territorial, technical, risk-based and other criteria, if such differentiation is not prohibited by Applicable Law.
10. Refunds, cancellation of transactions and the right of withdrawal
10.1. An Account is Topped Up in order to immediately acquire conventional units and then use them within the functionality of the Platform. Unless Applicable Law expressly provides otherwise, the unused Internal Balance is not money, electronic money or a separate payment instrument and cannot be withdrawn back or exchanged for money.
10.2. By confirming a Top-up, the User instructs the Operator to start providing the relevant digital service and to credit the conventional units immediately after the payment is confirmed. In the cases provided for by Applicable Law, the User gives separate consent to performance starting before the statutory withdrawal period expires and confirms that they understand the legal consequences of such consent, including the loss of the right of withdrawal in the cases provided for by law.
10.3. From the moment conventional units are used, including for an Upgrade or a Contract, or an Item is received, used or disposed of, the relevant transaction is deemed final and cannot be cancelled merely because the User changed their mind, except where the right to cancel or to a refund is expressly provided for by Applicable Law.
10.4. The restrictions established by this section do not exclude or limit the User’s mandatory rights, in particular where a paid service was not provided, in the case of a double or erroneous debit, an unauthorised payment transaction or a confirmed Technical Error. The User must notify the Operator of a suspected error without undue delay, where possible within 72 hours of discovering it; missing this period does not in itself extinguish the rights granted to the User by law, but may be taken into account when assessing the circumstances and whether a check is possible.
10.5. If a refund is mandatory under Applicable Law or separately approved by the Operator, it is made, as a rule, to the original means of payment and in the currency of the original payment, after the identification, technical, anti-fraud and other checks required by law or by payment partners have been carried out. A refund to a means of payment, bank account, electronic or cryptocurrency wallet or address of a third party is not allowed, except where a refund by the original method is objectively impossible and provided that the alternative method is permitted by law and by the relevant payment partner.
10.6. To consider a refund claim, the Operator may request the Account identifier, information and documents confirming the relevant payment transaction and that the means of payment belongs to the User, and other reasonably necessary information. Until the User has been identified and the circumstances of the transaction checked, the execution of the claim may be suspended. The Operator aims to give an initial response within 10 business days from the date it receives a sufficient set of information, but this period may be extended if an additional check, interaction with a payment partner or an external investigation is necessary.
10.7. Fees, conversion costs and exchange rate differences withheld by banks, payment systems, providers or other independent third parties are reimbursed only to the extent the relevant amounts were actually returned to the Operator or the obligation to reimburse them is expressly provided for by Applicable Law. A refund is not made by providing another Item, unless that method is separately agreed by the User and the Operator after the ground for the refund arises.
10.8. Bonuses, promotional balances and other free credits have no separate refundable value. When a Top-up is refunded, the Operator may, to the extent permitted by Applicable Law, cancel the unused bonuses, conventional units and other results related to that Top-up whose receipt was directly conditional on the refunded payment. The amount of an approved refund may also be set off against the User’s confirmed debt, a negative balance, the amount of a chargeback or documented direct damage, if such a set-off is permitted by Applicable Law.
10.9. The expiry or non-expiry of any fixed period, including 14 calendar days from the date of payment, does not in itself create an unconditional right to a refund and does not exclude it. The existence, scope and manner of exercising the User’s right of withdrawal, cancellation of a transaction or refund are determined by the nature of the relevant transaction, whether performance has started or been completed, the applicable mandatory rules and the other circumstances of the particular case.
11. Chargebacks, disputed and unauthorised payments
11.1. If there are doubts about a payment, its amount, status or legitimacy, the User must, where objectively and reasonably possible, contact the Operator’s support before initiating a chargeback or other payment dispute and provide sufficient information to identify the relevant transaction. This provision does not limit the User’s mandatory rights to contact their bank, payment provider or other authorised person directly in the cases provided for by Applicable Law.
11.2. A knowingly false claim that a payment was unauthorised, erroneous or not made by the User, in particular after the conventional units acquired have actually been credited and used, transactions have been carried out on the Platform or Items have been obtained with the relevant Top-up, is a material breach of this Agreement and, where there are grounds provided for by law, may be classified as bad-faith or fraudulent behaviour.
11.3. From the moment it receives notice of a chargeback, a dispute or an alleged unauthorised payment, the Operator may, for the period of the check, fully or partially restrict individual functions of the relevant Account, including new transactions, use of the Internal Balance, disposal of Items and Withdrawals, solely to the extent and for the period objectively necessary to prevent further damage, preserve evidence and resolve the payment dispute.
11.4. If the original payment is subsequently reversed, refunded or declared invalid, or the amount of such payment is debited from the Operator by a bank, payment system or payment partner, the relevant Top-up is deemed cancelled to that extent. The Operator may make the necessary accounting adjustments, including reversing unused conventional units and other credits directly related to the cancelled payment, within the limits of technical feasibility and Applicable Law.
11.5. If conventional units obtained with a payment that was later cancelled or disputed were fully or partially used before its cancellation, the Operator may adjust the Internal Balance and the results of transactions directly related to that payment to the extent technically possible, legally permissible and necessary to restore the position that would have existed without the relevant payment.
11.6. If the adjustments provided for by this section result in a negative Internal Balance or another confirmed debt of the User to the Operator, the Operator may temporarily restrict new Top-ups, transactions, the use of individual functions of the Platform and Withdrawals until such debt is repaid or the relevant payment dispute is finally resolved.
11.7. If it is established that the User initiated a chargeback intentionally and knowing it to be unjustified, the Operator may demand reimbursement of the actually incurred and documented fees, charges and other direct costs imposed by the bank, payment system or payment partner directly in connection with that chargeback, solely to the extent such a claim is permitted by Applicable Law.
11.8. Disputing a payment in good faith, contacting a bank, payment institution or competent state authority, or using other legal means of protecting one’s rights is not in itself a breach of this Agreement and does not entail the unconditional cancellation of the entire Internal Balance, confiscation of all Items or other measures unrelated to the subject of the relevant dispute.
11.9. To consider and resolve a payment dispute, the Operator may provide banks, payment systems, acquirers, payment providers and other persons involved in processing the payment with the necessary information and evidence, including data about the Account, the relevant transactions, the use of conventional units, Items received, technical and Server Data and other documents relating to the dispute, subject to the Privacy Policy and the requirements of Applicable Law.
11.10. Once a final decision on a payment dispute takes effect, the Operator adjusts the accounting and the restrictions applied accordingly. If the dispute is resolved in the User’s favour, restrictions caused solely by that dispute are lifted and the accounting is restored to that extent. If the dispute is resolved in the Operator’s favour or a breach of this Agreement by the User is confirmed, the Operator may apply the measures provided for herein to an extent proportionate to the established breach and its actual consequences.
11.11. Regardless of the outcome of a particular payment dispute, the Operator may, based on an objective assessment of payment, anti-fraud and compliance risk, restrict or refuse further Top-ups from a particular means of payment or set additional verification requirements for the relevant Account or means of payment, if there are reasonable grounds to believe that their further use creates an increased risk of repeated chargebacks, unauthorised transactions, fraud or other abuse.
12. Technical errors, failures and the evidential value of data
12.1. The Platform is a complex software and technical service whose operation depends, among other things, on software, server infrastructure, communication networks and integrations with third parties. During operation, individual functions may be temporarily unavailable, transaction processing may be delayed, display errors may occur, the user interface and the Server Data may be out of sync, external integrations may be interrupted and other technical deviations may occur.
12.2. The Operator may carry out scheduled and emergency technical, preventive and other necessary work, during which individual functions of the Platform may be temporarily restricted or unavailable and transaction processing may be suspended or queued. Where reasonably technically possible, information about significant scheduled work is brought to the attention of Users in advance.
12.3. In the event of a discrepancy between the information displayed in the user interface, including animation, the graphical display of a result, notifications, locally stored or cached data, and the corresponding Server Data, the Server Data prevail, unless a check establishes that they are technically erroneous or the User provides sufficient evidence to the contrary. The visual or animated display of a result does not in itself change the actual result of the transaction recorded on the server side.
12.4. Server Data, event and transaction logs, transaction identifiers, timestamps, information about changes in the Internal Balance, and data of payment partners, Steam and other integrated services relating to the relevant transaction may be used by the Operator as evidence of the fact, time, sequence and result of the actions performed. Such information is assessed together with other available evidence and does not limit the User’s right to submit their own materials, including screenshots, videos and screen recordings.
12.5. If a duplicated request, an anomalous result, an incorrect price, a repeated or excessive credit or debit, a broken order of data processing or other circumstances indicating a probable Technical Error are detected, the Operator may suspend the relevant incomplete transaction, temporarily restrict the disposal of assets directly related to it and carry out a technical check.
12.6. If the check confirms that conventional units, an Item or another asset were credited erroneously or excessively due to a Technical Error, the Operator may cancel the relevant credit, adjust the Internal Balance and related records or, to the extent technically possible and permitted by Applicable Law, restore the state of the Account that existed immediately before the error. The mere fact of an erroneous display or credit does not give the User an unconditional right to keep an asset whose receipt obviously did not match the actual terms of the transaction.
12.7. If a confirmed Technical Error resulted in an excessive debit of conventional units, the loss of an Item or another incorrect reduction of the value recorded on the Account, the Operator makes the corresponding adjustment by restoring the erroneously debited number of conventional units, the Item or another result provided for by the Platform, within the limits of technical feasibility and taking into account the requirements of Applicable Law.
12.8. The consequences of a Technical Error are adjusted solely in order to eliminate a confirmed technical deviation and are not grounds for revising a correctly completed transaction because of a result unfavourable to the User, a subsequent change in the market or other value of an Item or the actual result not meeting the User’s subjective expectations.
12.9. If a confirmed Technical Error directly affected a subsequent sequence of interrelated transactions in such a way that the relevant results objectively could not have arisen without the original error, the Operator may adjust or cancel the chain of transactions directly related to it. In doing so, the state is restored, as far as technically and legally possible, to one as close as possible to the state that would have existed without the relevant error.
12.10. The User must refrain from intentionally exploiting an obvious Technical Error, malfunction or vulnerability of the Platform and, having discovered such circumstances, must stop actions aimed at benefiting from the error and notify support. Knowingly continuing to exploit an error known to the User may be treated as abuse of the functionality of the Platform and taken into account by the Operator when applying the measures provided for by the Agreement.
12.11. When carrying out a technical check, the Operator may request from the User the information objectively necessary to establish the circumstances of the event, including the approximate or exact time it occurred, the transaction identifier, information about the device and software, data about the relevant payment, and any available screenshots or videos. Failure to provide information available to the User is not automatically grounds for refusing to consider the request, but may objectively lengthen the check or limit the possibility of establishing the circumstances of the event.
12.12. The Operator is not obliged to provide the User with source code, internal technical documentation, information about the architecture of the Platform, the algorithms and models of anti-fraud systems, keys, information security tools or other restricted information if its disclosure may threaten the security of the Platform, help circumvent protection mechanisms, or breach the rights of third parties, confidentiality obligations or the requirements of Applicable Law.
12.13. If restoring a particular Item or the original technical state is objectively impossible, the way to remedy the consequences of a confirmed Technical Error is determined based on the nature of the deviation, the actual state of the Account, the value of the relevant asset at the time the error occurred, the technical feasibility of restoration and the requirements of Applicable Law. A subsequent change in the value of an Item is not in itself grounds for increasing the amount of the relevant compensation.
12.14. The User must take reasonable and available measures to prevent the possible negative consequences of a Technical Error from increasing, including stopping repeated identical transactions in the event of an obvious failure and promptly contacting support. When determining the consequences of the relevant incident, it may be taken into account whether the User’s deliberate actions or omissions contributed to an increase in the damage after the existence of the error became or should have become obvious to them.
13. Circumstances beyond the Operator’s control
13.1. The operation of the Platform depends to a certain extent on the proper functioning of independent third parties and external infrastructure, including Steam and Valve Corporation, the developers of the relevant games, payment institutions, banks, payment service providers, telecom operators, cloud and server infrastructure providers, information and other technology services. The Operator does not fully control the activities of such persons and does not guarantee the continuity, invariability or constant availability of the services they provide.
13.2. Valve and other owners of third-party services may on their own change the rules and technical conditions of use of their services, restrict or suspend trading functions, set trade hold periods, change how inventories, APIs and other integrations work, block or restrict user accounts and stop providing individual functions. The Operator does not guarantee that the rules, technical capabilities or functionality of such services in force at any given time will be preserved.
13.3. Items related to Steam or the relevant game are digital objects whose existence, use, transfer and other characteristics are determined by the rules and technical infrastructure of the relevant third-party service. Unless Applicable Law expressly provides otherwise, such Items are not tangible things, and their display or recording on the Platform does not in itself change the legal regime established by the relevant third-party service.
13.4. The User must independently comply with the Steam Subscriber Agreement, the rules of the relevant game, Steam restrictions and other applicable terms of third parties. A breach of such terms by the User, including trading or Steam Account usage restrictions, may make the Withdrawal, receipt, transfer or subsequent use of Items impossible or delayed and does not give rise to the Operator’s liability unless the relevant consequences were caused by actions or a breach on the part of the Operator.
13.5. The Operator is not liable for the blocking or restriction of a Steam Account, the setting of a trade hold, the cancellation or rejection of a trade offer, the unavailability or restriction of an inventory, a change in the characteristics, circulation rules or availability of Items, the shutdown of an API or other actions or decisions of Valve or another independent third party, if such circumstances arose beyond the Operator’s reasonable control and were not caused by a breach of its own obligations.
13.6. The Operator does not guarantee the constant availability of a particular Steam bot, trading account, payment channel, external API or other technical means used to interact with third-party services. At the same time, the Operator must in good faith record actually completed transactions and remedy confirmed errors that arose directly in the Operator’s own accounting systems.
13.7. If an external integration is temporarily or permanently unavailable, the relevant service shuts down or an external technical restriction arises, the Operator may determine a reasonable and technically feasible way of settling incomplete transactions, including waiting for the relevant functionality to be restored, restoring conventional units, Automatic Sale, replacing the technical method of execution or another comparable method permitted by this Agreement and Applicable Law.
13.8. The temporary or permanent impossibility of transferring a particular Item due to restrictions of Steam, Valve or another external system does not in itself turn the Internal Balance into a monetary obligation of the Operator and does not give the User an unconditional right to demand its payment in money, unless Applicable Law expressly provides otherwise.
13.9. Links, interface transitions and other means of access to third-party websites, applications or services may be provided solely to ensure the functionality of the Platform or for the User’s convenience. Unless the law expressly provides otherwise, the Operator does not control and is not responsible for the content, availability, security, fees, terms of use or independent data processing of such third parties.
13.10. The User provides and pays for the equipment, software, internet connection, access to Steam and other technical means necessary to use the Platform on their own. The Operator is not liable for the impossibility or improper use of the Platform caused by a malfunction or incompatibility of the User’s equipment, software, internet connection or third-party accounts.
13.11. The Operator and the relevant third parties are independent participants in legal relations within the scope of the services they provide. Unless expressly provided otherwise, this Agreement does not create agency, partnership or other representative relations between the Operator and Valve or another third-party provider and does not entitle the User to demand that such third party perform the Operator’s obligations or that the Operator perform the obligations of the relevant third party.
14. Prohibited actions of the User
14.1. The User must use the Platform in good faith, personally, in accordance with its purpose, this Agreement and Applicable Law. The User may not take actions aimed at circumventing the rules, restrictions, security mechanisms, control and risk management established by the Operator.
14.2. It is prohibited for one User to create or use several Accounts unless expressly permitted by the Operator, to transfer, sell or rent an Account or give third parties access to it, to manage an Account jointly, to register using the data of a front person or other third party, or to connect or use a Steam Account that the User is not entitled to dispose of.
14.3. It is prohibited to Top Up using a stolen, forged, invalid or compromised means of payment or one belonging to a third party without the proper consent of its lawful owner, as well as to use payment details, documents or identification data obtained unlawfully or provided to the Operator in order to mislead it or a payment partner.
14.4. It is prohibited to use the Platform as a payment, settlement or transit instrument, including to transfer value between third parties, cash out funds, conceal or misrepresent their origin, carry out transit transactions, arbitrage payment instruments, launder proceeds, finance unlawful activity or circumvent payment, sanctions, compliance or other established restrictions.
14.5. It is prohibited to use VPNs, proxy servers, means of spoofing an IP address or geolocation, device emulation, forged or false documents, other people’s identification data and other technical or organisational means if the purpose or actual result of such use is to circumvent territorial, age, sanctions, payment, identification or other restrictions applied by the Operator or provided for by Applicable Law.
14.6. It is prohibited to interfere without authorisation with the software or infrastructure of the Platform, including decompiling, reverse engineering, altering or substituting requests and responses, injecting program code, circumventing authentication or security measures, unauthorised access, intercepting data, DDoS attacks, placing excessive load on the API, and searching for, scanning or exploiting vulnerabilities without the Operator’s prior permission, except in the cases and to the extent expressly permitted by Applicable Law.
14.7. It is prohibited to use bots, scripts, macros, auto-clickers, emulators, specialised extensions and other means of automation to carry out Game Transactions, receive or collect rewards, send requests in bulk, manage an Account automatically or gain advantages over other Users, unless such automation is expressly provided for by the functionality of the Platform or permitted in advance by the Operator.
14.8. It is prohibited to knowingly exploit Technical Errors, vulnerabilities, delays in price updates, duplication of transactions, data desynchronisation, incorrect credits, erroneous displays or other technical deviations in order to obtain conventional units, Items, advantages or any other result that the User knew, or in the circumstances should reasonably have understood, to be erroneous.
14.9. Collusion with other Users, manipulation of transactions or results, creation of fictitious activity, artificial inflation of indicators, circumvention of established limits, and the bad-faith or repeated use of bonus, promotional, referral programmes, refund mechanisms or other incentive functions in a way that does not match their purpose are prohibited.
14.10. Without the Operator’s prior written consent, it is prohibited to accept money or other assets of third parties for subsequent use on the Platform, to manage other people’s Accounts for commercial or intermediary purposes, to sell or otherwise give third parties a promise of a Withdrawal, and to organise on the basis of the Platform intermediary, exchange, settlement or other commercial services not provided for by its functionality.
14.11. It is prohibited to impersonate the Operator, its employee, a support representative, a payment partner or another User, to use confusingly similar designations, to create phishing or imitation websites, pages and interfaces, to spread knowingly false messages on behalf of the Operator or otherwise mislead third parties about one’s connection with the Platform.
14.12. Without the relevant permission, it is prohibited to systematically copy, parse, scrape, extract in bulk, reproduce, distribute or commercially use the software elements, databases, texts, design, graphic materials and other objects of the Platform in an automated way, except where the relevant action is expressly permitted by Applicable Law.
14.13. It is prohibited to use the Platform to commit unlawful acts, infringe the intellectual, property, personal or other rights of third parties, distribute malicious software, commit fraud, carry out illegal advertising, make threats or engage in any other activity prohibited by Applicable Law.
14.14. The User must stop the relevant action after receiving a reasoned notice from the Operator that it breaches this Agreement or poses a significant threat to the security, stability or lawful operation of the Platform. The User may contact support for clarification and to dispute the relevant restriction in the manner established by the Operator.
14.15. An attempt to perform any of the actions prohibited by this section may be treated as a breach regardless of whether the intended result was achieved, if the totality of the Server Data and other objective circumstances reasonably confirms that the User’s actions were aimed at committing the relevant breach.
14.16. When a suspected breach is detected, the Operator may take into account the totality of the available technical, payment, behavioural and other objective signals. Significant property consequences should not be applied solely on the basis of an unexplained automatic signal of a monitoring system without a reasonable check of the circumstances, except for temporary protective measures necessary to prevent immediate damage, fraud or a further breach.
15. KYC, AML/CFT
15.1. In order to ensure the security of the Platform and prevent fraud, misuse of means of payment, money laundering, terrorist financing, circumvention of sanctions restrictions and other unlawful acts, the Operator may apply risk-based procedures of identification, verification, monitoring and checking of Users and their transactions (KYC, AML/CFT, sanctions screening and anti-fraud controls) to the extent provided for by Applicable Law, the requirements of payment partners and a reasonable assessment of the relevant risks.
15.2. By using the Platform, the User confirms that the money and other assets they use in connection with the Platform are of lawful origin and that the User has the necessary rights and authority in respect of each means of payment, Steam Account, document, identification data and other information provided. The User may not provide information or documents of third parties without a proper legal basis.
15.3. The Operator may initiate an initial or repeated check of the User, in particular when an Account is registered or used, a Top-up is made, established value or transaction limits are reached, a Withdrawal is requested, geographical or payment parameters change significantly, a payment dispute arises, unusual or anomalous activity is detected, information about a possible breach is received or another objective risk indicator is present.
15.4. As part of a check, the Operator may request information and documents reasonably necessary to identify the User and confirm the lawfulness and economic nature of the relevant transactions, including an identity document, proof of address, information about the source of funds and, where justified by the level of risk, the source of wealth, a bank or other payment statement, proof of ownership of a means of payment, a selfie, video verification or a liveness check, information about the Steam Account and explanations of individual transactions.
15.5. The scope and depth of a check are determined taking into account the nature and size of the transactions, the risk factors identified, the requirements of the relevant payment or verification partner and Applicable Law. The Operator may request documents or information again if the information previously provided is out of date, does not allow the check to be completed, contains significant discrepancies, or if new circumstances or risk indicators have arisen since it was provided.
15.6. Until the necessary check is completed, the Operator may temporarily fully or partially restrict Top-ups, Game Transactions, Withdrawals, the disposal of Items and other functions of the Account to the extent and for the period reasonably necessary to carry out the check, prevent possible damage, comply with Applicable Law or meet the mandatory requirements of payment and other authorised partners.
15.7. The User’s unjustified refusal or evasion of a necessary check, systematic failure to provide requested information, or the provision of materially contradictory, inaccurate, misleading or presumably forged information may be grounds for keeping the relevant restrictions in place, refusing to carry out individual transactions or ending service to the User after a reasonable assessment of the circumstances and to the extent permitted by Applicable Law.
15.8. The User is prohibited from directly or indirectly using the Platform in the interests or on behalf of a person subject to sanctions or other restrictive measures binding on the Operator, as well as from taking actions aimed at concealing such person, the origin or purpose of funds, the actual participant in a transaction or at circumventing applicable sanctions restrictions.
15.9. The Operator may check the User, the identification data, payment details and other transaction-related information they provided against lawful sources available to the Operator, including applicable sanctions lists, information about politically exposed persons (PEP), anti-fraud databases, data of verification and payment partners and other sources whose use is permitted by Applicable Law.
15.10. Personal data, documents and other information obtained during the checks provided for by this section are processed in accordance with the Privacy Policy and Applicable Law and may be kept for the periods necessary to fulfil legal obligations, resolve disputes, confirm the checks carried out, prevent fraud and protect the legitimate interests of the Operator and third parties.
15.11. The Operator may transfer information relating to the User and their transactions to competent state authorities, payment institutions, banks, verification and other authorised persons where there is a relevant legal basis, a binding demand or a lawful request. The Operator may limit the disclosure to the User of information about a check being carried out, its methods, results or the transfer of information, if such disclosure is prohibited by law, may obstruct a check or investigation or may create a risk of security and control mechanisms being circumvented.
15.12. The detection of a risk indicator, a database match or other suspicious activity does not in itself establish a breach on the part of the User. Whether reports must be sent to the competent authorities, transactions blocked, restrictions kept in place or other measures taken is determined by the Operator based on the specific circumstances and the requirements of Applicable Law; this Agreement does not establish an unconditional obligation to apply the same measures to every suspicion detected.
15.13. Once the circumstances that served as grounds for a check or temporary restrictions have been eliminated, the Operator lifts the relevant restrictions within a reasonable time, unless there are other lawful grounds for keeping them. If a breach is confirmed, the Operator may apply the measures provided for by this Agreement and Applicable Law that are proportionate to the nature of the breach, the established risk and its actual consequences.
15.14. Carrying out a check in accordance with this section is a standard risk management measure and does not in itself mean that the User is accused of unlawful acts. Such procedures are applied to protect the Platform, its Users, payment partners and other third parties and to ensure compliance with applicable legal and contractual requirements.
16. Monitoring
16.1. In order to ensure the security of the Platform, prevent fraud and other abuse, perform this Agreement and comply with Applicable Law, the Operator may carry out automated and manual monitoring of Accounts, payments, Game Transactions, devices, network and technical parameters and other objective signals that make it possible to detect interconnected Accounts, anomalous activity and potential breaches.
16.2. Where there are reasonable grounds to believe that an Account, a transaction or the User’s actions may be connected with a breach of this Agreement, fraud, a Technical Error, an unauthorised payment, a security threat or other unlawful activity, the Operator may initiate a check, preserve data and evidence relating to the relevant event, request the necessary information and explanations from the User and apply temporary protective measures.
16.3. For the period of the check, the Operator may temporarily restrict Top-ups, Game Transactions, use of the Internal Balance, disposal of Items, Withdrawals or other directly affected functions of the Account. The scope and duration of such restrictions must correspond to the nature of the suspected risk and may change as additional information is received and assessed.
16.4. Based on the results of the check, the Operator may stop applying the temporary restrictions or, depending on the nature and seriousness of the established breach, issue a warning, cancel a wrongly obtained bonus or other credit, adjust an erroneous transaction, restrict the use of individual functions of the Platform, set additional verification requirements, stop further service to the User or apply other proportionate measures provided for by this Agreement and Applicable Law.
16.5. A particular Item, credit or transaction may be cancelled or adjusted if a reasonable check establishes its direct connection with a confirmed Technical Error, fraud, an unauthorised or subsequently cancelled payment, exploitation of a vulnerability, abuse of the functionality of the Platform or another breach without which the relevant result would not have been obtained.
16.6. A complaint by the User, the good-faith initiation of a payment dispute, the use of a legal mechanism for protecting one’s rights or an unconfirmed suspicion is not in itself sufficient grounds for the unconditional cancellation of the entire Internal Balance, all Items or other results of transactions belonging to the User.
16.7. In the event of a confirmed breach, the Operator may, where permitted by Applicable Law, withhold, reverse or set off an amount necessary to cancel an erroneous or wrongful credit, cover a cancelled payment, eliminate a negative balance and compensate documented direct damage that arose directly from the relevant breach. Such measures must not exceed the amount of the relevant debt or established damage, unless the law expressly provides otherwise.
16.8. The Operator may permanently stop service and close or block an Account in the event of a material or repeated breach of this Agreement, confirmed fraud or other unlawful behaviour, circumvention of previously applied restrictions, unjustified refusal of a mandatory check, creation of a significant threat to the security of the Platform or third parties, or if further service to the User is objectively impossible without breaching Applicable Law or the mandatory requirements of the relevant payment partner.
16.9. When stopping or significantly restricting service, the Operator may withhold from the User the specific algorithms, rules of anti-fraud systems, internal risk indicators, methods of detecting interconnected Accounts and other information whose disclosure may threaten security or help circumvent control mechanisms. At the User’s request and to the extent permitted by law and security requirements, the Operator may state the general category of circumstances on which the decision was based.
16.10. The User may send support a reasoned objection to the applied measure and provide documents, information or other evidence relevant to reviewing the decision. Such a request must be considered by the Operator or a person authorised by it who is able to assess the materials provided and, where there are sufficient grounds, change or cancel the original decision.
16.11. Restrictions applied to one Account may be extended to other Accounts only where there are objective technical, identification, payment or other data indicating common control over such Accounts, their use in a joint breach, or the creation or use of an additional Account to circumvent previously applied measures.
16.12. When carrying out checks and preventing and investigating breaches, the Operator may interact with payment institutions, banks, verification and anti-fraud providers, Valve, the relevant right holders, technical service providers and competent state authorities, and provide them with the necessary information where there is a proper legal basis and in compliance with the Privacy Policy and Applicable Law.
16.13. If the check does not confirm the suspected breach, the Operator lifts the restrictions caused solely by that check and, where necessary, restores the correct state of the accounting within a reasonable time. A change in the market, trading or other external value of Items during a reasonable check does not in itself create a right to compensation for the difference, except where such compensation is expressly provided for by Applicable Law.
16.14. Notwithstanding the other provisions of this section, the Operator may immediately apply the necessary technical and protective measures without prior notice to the User if delay could lead to the continuation of a cyberattack, a leak or compromise of data, mass fraud, unauthorised withdrawal of assets, a breach of the security of the Platform or other immediate and significant damage. Once the immediate threat has been eliminated, the need for and scope of further restrictions must be reviewed in the light of the circumstances actually established.
17. Intellectual property and personal data
17.1. The exclusive and other rights to the Platform and its components, including software, source and object code, architecture, interfaces, design, texts, graphic elements, databases, structure, selection and arrangement of materials, belong to the Operator or the relevant right holders and are protected in accordance with Applicable Law and applicable international agreements.
17.2. For the lifetime of the Account and subject to compliance with this Agreement, the Operator grants the User a limited, non-exclusive, non-transferable, non-sublicensable and revocable right to use the available functionality and interface of the Platform solely for personal, non-commercial purposes and within its intended purpose. This right does not mean that any exclusive rights to the Platform or its individual elements are transferred to the User.
17.3. Unless expressly permitted by the Operator or Applicable Law, the User may not reproduce, copy, modify, adapt, distribute, publish, license, alienate or commercially use materials of the Platform, create derivative products based on them, or remove, conceal or alter information about copyrights, trademarks and other designations of right holders.
17.4. The trademarks, trade designations, logos and other intellectual property of Valve, Steam, the developers of the relevant games and other third parties, as well as the related names, images and visual representations of Items, belong to the relevant right holders. The use of such objects within the Platform does not transfer to the Operator or the User any rights to them beyond the scope permitted by the relevant right holder and Applicable Law, and does not in itself indicate a partnership, sponsorship or endorsement of the Platform by the relevant right holder.
17.5. If the User voluntarily sends the Operator suggestions, feedback, comments, ideas or recommendations regarding the functionality and development of the Platform, the Operator may take into account and use such materials to improve the Platform without paying a separate remuneration, unless the User and the Operator have agreed otherwise in advance and expressly. This provision does not apply to personal data and other information whose legal regime is determined by Applicable Law.
17.6. The collection, use, storage, transfer and other processing of the User’s personal data are carried out in accordance with the applicable Privacy Policy and Applicable Law. The Privacy Policy is a separate document that determines, in particular, the categories of data processed, the purposes and legal bases of processing, the categories of recipients, the applicable retention periods, the procedure for cross-border transfers and the rights of data subjects provided for by law.
17.7. With the User’s separate, prior, freely given and unambiguous consent, the Operator may send informational and marketing messages to the confirmed email address, including information about bonuses, promo codes, news of the Platform, personalised and special offers. Such consent is given by an active confirming action in the interface of the Platform and is not a condition for registering an Account or using functions not directly related to the relevant mailing, unless Applicable Law expressly permits otherwise.
17.8. To set up and administer a subscription, the Operator may process the email address, identifiers and other necessary Account data, information about subscription settings and status, the fact and time consent was given or withdrawn, and technical data necessary to confirm the address, deliver messages and record interaction with them. The legal basis for such processing is the User’s consent and, in the cases expressly provided for by Applicable Law, another applicable legal basis specified in the Privacy Policy.
17.9. The User may at any time opt out of marketing messages using the “Unsubscribe” link in the relevant email, by changing the notification settings in the Account or by contacting support. Opting out of marketing mailings does not affect the lawfulness of processing carried out before consent was withdrawn and does not stop service, transactional, technical and other messages necessary to perform this Agreement, ensure Account security or meet the requirements of Applicable Law.
17.10. After receiving an opt-out, the Operator stops sending marketing messages without undue delay, allowing a reasonable time to technically update the mailing settings. Information about the opt-out may be kept to the extent and for the period necessary to respect the User’s choice, prevent messages from being sent again without new consent, demonstrate compliance with Applicable Law and protect the Operator’s legitimate interests.
17.11. To confirm email addresses, manage subscriptions and deliver messages, the Operator may engage providers of the relevant technology services, including OneSignal and the connected email service provider. The categories of data transferred, the specific recipients, the purposes and legal bases of processing, the places of processing, the conditions of cross-border transfers and the applicable retention periods are determined by the Privacy Policy and Applicable Law.
17.12. In connection with providing and operating the Platform, the Operator may process the information provided for by the Privacy Policy, including the Steam ID and other identifiers of linked accounts, Account data, IP address and network parameters, information about the device and software, cookies and similar identifiers, payment and transaction identifiers, transaction history, support requests, and information and documents obtained during identification, KYC, AML/CFT, sanctions and anti-fraud checks.
17.13. In order to ensure the security of the Platform, prevent fraud and abuse, detect anomalous activity and manage risks, the Operator may use automated means of analysis and decision-making to the extent permitted by Applicable Law. The Operator is not obliged to disclose algorithms, models, parameters, risk indicators and other technical information to an extent that could make it easier to circumvent control mechanisms, threaten information security or infringe the rights and legitimate interests of third parties.
17.14. Where Applicable Law gives the User the right to receive information about automated processing, to object as provided for by law, to request a review of a decision or the intervention of an authorised person, the relevant right may be exercised through the channels and in the manner specified in the Privacy Policy.
17.15. Ceasing to use the Platform or closing or deleting an Account does not result in the automatic and immediate destruction of all data related to the User. The Operator may or must continue to keep certain information for the period necessary to meet the requirements of Applicable Law, fulfil legal obligations, prevent and investigate fraud, resolve disputes and claims, confirm completed transactions, establish, exercise or defend legal claims and for other lawful purposes provided for by the Privacy Policy.
17.16. The User must provide the Operator with accurate information and warrants that there is a lawful basis for transferring the data and documents they provide. The User may not provide documents, personal data, payment details or other information of a third party without that person’s proper consent or another applicable legal basis, except where providing the relevant information is expressly required by Applicable Law.
18. Availability of the Platform, warranties and limitation of liability
18.1. The Platform and its functionality are provided “as is” and “as available”. To the maximum extent permitted by Applicable Law, the Operator gives no warranties other than those expressly provided for by this Agreement; this provision does not exclude or limit the mandatory warranties and other rights of the User that cannot be waived under Applicable Law.
18.2. The Operator does not guarantee that the Platform will operate continuously, without errors or fully protected against technical failures, or that a particular function, Item, Top-up or Withdrawal method, Steam bot, payment channel or third-party integration will always be available. A temporary restriction or end of availability of individual elements of the Platform is not in itself a breach of the Operator’s obligations if the relevant circumstance is beyond its reasonable control or is related to necessary technical or protective measures.
18.3. The Operator applies reasonable organisational and technical measures appropriate to the nature of its activities to ensure the security of the Platform and the data processed. At the same time, a mention or use of particular payment technologies, banks, payment systems or providers does not mean that the Operator claims to comply on its own with PCI DSS, Visa Secure (Verified by Visa), Mastercard Identity Check (Mastercard SecureCode) or other industry standards, unless such compliance is expressly confirmed by a document or certification applicable to the Operator.
18.4. The Operator is not liable for the actions or omissions of the User, including disclosing passwords, confirmation codes or other means of authentication to third parties, insufficient protection of a device or Steam Account, installing or using malicious or compromised software, or other circumstances that arose on the User’s side and are beyond the Operator’s reasonable control. This limitation does not apply to the extent the relevant damage is directly caused by the Operator’s own breach of its obligations.
18.5. The Operator does not control or guarantee that a particular market value, liquidity, characteristics, rarity or availability of Items will be maintained. Nor does the Operator guarantee that the User will make a profit or obtain any other economic benefit, that a Top-up will pay off, that an Item of a particular value will be obtained, or that a particular Item can be transferred or Withdrawn at the moment chosen by the User, where the relevant result depends on the functionality of the Platform, market conditions, the actions of Valve, the game developer or other circumstances beyond the Operator’s reasonable control.
18.6. To the maximum extent permitted by Applicable Law, the Operator is not liable for indirect, consequential, special, punitive or assumed losses, lost profit or income, loss of an expected economic opportunity or chance, a subsequent change in the market value of Items, reputational harm and other losses that are not a direct and reasonably foreseeable consequence of an established breach of this Agreement by the Operator.
18.7. If the User’s claim relates directly to one particular transaction, the Operator’s total liability in connection with that transaction is limited, to the maximum extent permitted by Applicable Law, to the amount of the direct damage actually incurred and documented and in any case does not exceed the amount actually paid by the User to the Operator in connection with the relevant disputed transaction.
18.8. If a claim cannot reasonably be attributed to one particular transaction, the Operator’s total liability for all interrelated claims arising from one event or a series of related events within the relevant twelve-month period is limited, to the maximum extent permitted by law, to the total amount of payments actually made by the User to the Operator during the three months immediately preceding the event that gave rise to the claim.
18.9. The limitations and exclusions of liability provided for by this section do not apply to fraud or wilful misconduct of the Operator, liability for death or personal injury caused by negligence in the cases provided for by law, breach of other obligations for which liability cannot be excluded or limited by agreement of the parties, or in other cases where the relevant limitation is expressly prohibited by Applicable Law.
18.10. The User must take reasonable and available measures to prevent and reduce possible damage, in particular stop repeated transactions after discovering an obvious error or other problem and promptly notify the Operator of the relevant circumstances. To the extent permitted by Applicable Law, the Operator is not liable for the part of the damage that arose or increased because the User unreasonably failed to take reasonable measures to prevent or reduce it.
18.11. No provision of this section releases the Operator from the obligation to make the necessary correction of its own confirmed Technical Error in the accounting, to comply with a binding decision of a competent authority that has taken effect, or to provide the User with a remedy that is mandatory and cannot be excluded or limited under Applicable Law.
18.12. The Operator is not liable for the failure or delay in performing its obligations to the extent they are directly caused by extraordinary circumstances beyond its reasonable control, including natural disasters, fires, hostilities, mass riots, actions or prohibitions of state authorities, mandatory sanctions restrictions, large-scale communication or power outages, significant cyberattacks, the shutdown or significant restriction of Steam, payment, banking, cloud or other critically necessary external infrastructure, and other comparable unavoidable circumstances (force majeure).
18.13. A party whose performance of obligations is prevented by force majeure is released from liability only for the duration and to the extent of the actual impact of the relevant circumstances. Such party must, as far as reasonably possible, take measures to limit the consequences of the relevant event, restore performance and properly perform the obligations not affected by force majeure.
18.14. To the extent permitted by Applicable Law, the User must compensate the Operator for the direct losses actually incurred and documented, mandatory fees and reasonable claims of third parties that arose directly from the User’s proven intentional fraud, their use of an unlawful or unauthorised means of payment, infringement of the rights of third parties or intentional circumvention or breach of the security mechanisms of the Platform. The obligation to compensate does not extend to losses to the extent they are caused by actions or a breach of the Operator, the application of unjustified or disproportionate measures or other circumstances for which the User is not liable under Applicable Law.
18.15. Each exclusion or limitation of liability provided for by this section applies separately and only to the maximum extent permitted by Applicable Law. A finding that a particular limitation is wholly or partly invalid, unenforceable or inapplicable does not affect the validity of the remaining provisions of this section and shall not be construed as extending their content beyond what is expressly provided for by this Agreement.
19. Final provisions
19.1. Before going to court, the User is advised to send the Operator a written claim through the official support channel, stating information sufficient to identify the User and the disputed transaction, including the Steam ID, the Account or transaction identifier, the date of the event, a description of the circumstances and the claim being made. If a mandatory pre-trial procedure is established by Applicable Law, it is followed in accordance with the relevant mandatory requirements. Claims relating to an alleged Technical Error should be sent without undue delay, if possible within 72 hours of its discovery; this period is a recommendation and does not shorten the statutory periods for making claims or the limitation periods.
19.2. The Operator confirms receipt of a claim through an available communication channel and aims to give a substantive reply within 30 calendar days of receiving information sufficient for its review. This period may be reasonably extended if the complexity of a technical, payment or other review, the need to obtain additional information, the involvement of a payment partner, Valve or another third party, or the requirements of Applicable Law so require.
19.3. This Agreement and the contractual relations arising from or in connection with it are governed by the laws of the Kyrgyz Republic without regard to its conflict-of-laws rules. Disputes are subject to consideration by the competent courts of the Kyrgyz Republic at the Operator’s location, unless mandatory rules of Applicable Law give the User the right to have the dispute considered by another competent court. The choice of applicable law and jurisdiction does not deprive a User who is a consumer of the protection they cannot waive under the mandatory laws of the country of their habitual residence, where such rules apply to the relevant relations regardless of the parties’ choice of law.
19.4. This edition of the Agreement takes effect on 27 August 2026 or, if it was actually published on the Website later than that date, on the date of such publication, and remains in force until a subsequent edition takes effect. A new edition applies to actions, Top-ups, Game Transactions, Withdrawals and other legally significant events that take place after its effective date, as well as to continuing relations as regards the subsequent use of the Account, the Internal Balance, the Inventory, uncompleted transactions, reviews and requests.
19.5. Transactions and other legally significant actions fully completed before a new edition takes effect are assessed on the basis of the terms of the Agreement and the rules of law applicable at the time they were performed. A new edition is not applied so as to retroactively establish a new breach, a new obligation or additional liability of the User, or to terminate a right they have already acquired. At the same time, the procedural provisions of the current edition concerning reviews, the provision of information, temporary protective measures and the assessment of evidence may be applied to a continuing dispute about a previously performed transaction, if such application does not worsen the mandatory rights of the User and does not establish retroactive liability.
19.6. To detect and investigate Technical Errors, duplicated transactions, chargebacks, fraud, abuse and other breaches, the Operator may analyse the Server Data, payments, credits, Game Transactions and other actions relevant to the review that took place within 12 months before the review started, and over a longer period if the obligation or right to carry out such a review is provided for by Applicable Law. A previously performed transaction may be corrected if this possibility was provided for by the terms that applied to it, follows directly from the law, or is necessary to remedy a confirmed error as a result of which the User did not objectively acquire the relevant right or value.
19.7. The Operator may amend and supplement this Agreement. Material changes that worsen the contractual position of the User apply for the future after reasonable prior notice and, where required by Applicable Law, after the User’s separate consent is obtained. Continued use of the Platform after the changes take effect is regarded as acceptance of the new edition only in those cases and jurisdictions where such a form of consent is legally permissible. Changes may take effect without a prior notice period if this is objectively necessary to comply with the law or a mandatory requirement of a competent authority, to prevent fraud, to remedy a material vulnerability or to restore the safe operation of the Platform, provided that the User’s rights are not unlawfully worsened retroactively.
19.8. The Operator may keep records of the editions of the Agreement and evidence of their acceptance by the User, including the date and time, the Account identifier, the number or other identifier of the document version, the IP address and other permissible technical information. If the User does not agree with a new edition, they must stop making new transactions after it takes effect and may request that the Account be closed. The existing Internal Balance, Items, uncompleted transactions, debts and continuing reviews are settled in accordance with the applicable terms of the Agreement and mandatory rules of law, which does not in itself imply an automatic cash payment of the Internal Balance.
19.9. The Operator may stop providing the Platform entirely, or stop or significantly restrict its provision in a particular territory. Unless otherwise required by law, a competent authority, security or other circumstances requiring immediate action, the Operator gives Users reasonable prior notice and, as far as technically and legally possible, an opportunity to complete available uncompleted transactions and to dispose of the relevant Items.
19.10. The User may request that the Account be closed or deleted after the mandatory reviews, payment disputes and uncompleted transactions preventing such deletion have been completed. Before the Account is closed, the User may be given a reasonable period to use the available Internal Balance and to dispose of Items in the ways provided by the Platform. Closing or deleting the Account does not in itself convert the Internal Balance into a monetary claim against the Operator and does not create an obligation to pay it out in cash, unless expressly provided otherwise by Applicable Law. The mere fact of requesting deletion of the Account is not in itself a ground for confiscating the User’s values.
19.11. The Operator may transfer this Agreement and the related rights and obligations to its successor, an affiliate or the acquirer of the relevant business or a substantial part of its assets, provided that the User’s statutory rights are preserved and notice is sent where required by Applicable Law. The User may not assign or otherwise transfer their rights and obligations under this Agreement to a third party without the Operator’s prior consent, unless otherwise provided by mandatory rules of law.
19.12. The Operator’s failure to exercise, or delay in exercising, any right or remedy is not a waiver of that right and does not prevent its later exercise. If a particular provision of this Agreement is found invalid, unlawful or unenforceable, it applies to the maximum extent permitted by law or, where possible, is replaced with a permissible provision closest to its original lawful purpose, without terminating the remaining provisions of the Agreement.
19.13. This Agreement, together with the special rules, the Privacy Policy and other documents expressly incorporated into it by reference, constitutes the agreement of the parties on the subject matter they govern and supersedes prior arrangements in the relevant part, taking into account the rules on the effect of terms over time established by this section. In the event of a conflict between this Agreement and special rules, the special rules prevail solely with respect to the special matter they govern, unless expressly provided otherwise.
19.14. The Operator’s notices may be sent through the interface of the Platform or Account, by publication on the Website, by email or through another communication channel provided by the User or offered by the functionality of the Platform. Legally significant requests from the User are sent through the Operator’s official communication channels published on the Website. The User must keep the contact details they provided up to date and monitor messages sent through the channels provided for by this Agreement on their own.
19.15. This Agreement is drawn up in Russian. The Russian edition prevails in interpretation; translations into other languages are provided for reference.
19.16. Provisions of this Agreement that by their nature are intended to apply after use of the Platform has ended or the Account has been closed, including provisions on payment disputes and chargebacks, Server Data and evidence, intellectual property, data protection within the applicable retention periods, liability and compensation for losses, applicable law and dispute resolution, survive the end of the relationship to the extent and for the period necessary for the final settlement of the rights and obligations that have arisen between the parties.
